Permissibility of arbitration in general and in traffic particularly
Abstract
Pisac u ovom prilogu za savetovanje najpre razmatra ustavnost arbitraže u Srbiji, kao posebnoz načina rešavanja sporova i zaštite subjektivnih prava pored sudskoz načina. Tu ukazuje da Ustav Srbije ne predviđa bilo kakav druzi način zaštite prava pravnih subjekata i rešavanja sporova, osim sudskoz, čime se stvara nedoumica o tome da li su arbitraže uopšte dopuštene. Uprkos neprepoznavanju arbitraže u Ustavu, pisac zaključuje da njezova pravila o sudovima treba da se tumače tako da nisu smetnja takvom načunu rešavanja sporova. U nastavku rada se razmatra dopuštenost arbitražnoz načina rešavanja sporova u saobraćaju, u kojem je u pojedinim slučajevima opravdano zabranjen.
The writer of this paper considers constitutionality of arbitration in Serbia, as a special method of solving the contests and protecting the rights of persons at law, which is concurrent to judicial method. The Constitution of Serbia recognises just judicial way of protecting the rights of persons at law, which makes doubt if the arbitration is permissible at all. The writer thinks that there is a mistake in the Arbitration Act of Serbia, because it does not define arbitration as a type of court formed by the will of the parties in contest. He also considers permissibility of arbitral way of solving the contests in traffic, where exists justifiable reasons for its prohibition in special cases.
