U prvom naslednom redu kao naslednici se uvek javljaju ostaviočevi potomci, dok ostaviočev supružnik može nasleđivati ili istovremeno s njima i dobiti deo zaostavštine u svojinu, ili pak, dobiti samo pravo udovičkog užitka na delu zaostavštine. Autor analizira kako je u francuskom, austrijskom, nemačkom, švajcarskom i engleskom pravu uređen naslednopravni položaj supružnika u prvom naslednom redu, da bi na kraju uporedio dobre i loše strane svakog od pomenutih rešenja.

The author analyzes the French, Austrian, German, Swiss and English law related to the inheritance position of spouses in the first inheritance circle, so that at the end he would compare good and bad sides of every mentioned solution.
