Abstract
U članku se analizira jedan od ključnih pojmova Rosove jurispntdencije - pojam 'važećeg prava'. Analiza počinje prikazom opštih metodološko-epistemoloških polazišta Rosove teorije, nastavlja se detaljnim opisom njegove ideje 'važećeg prava'da bise okončala poređenjem Rosovih postavki sa sličnim postavkama američkih realista. To poređenje je ipak u Rosovu korist, makar se i određeni imanentni nedostaci redukcionističkog realizma nisu mogli izbeći ni u njegovoj teoriji.
The present article is an analysis of key concepts of Ross' jurisprudence i.e. of the concept of valid law. First elaborated are the methodological principles of Ross' theory, which is followed by detailed treatment of his ideas about valid law and by a comparison between his postulates and those of the American realists. That comparison is favoring Ross' ideas, although some immanent shortcomings of reductionism realism still remain inevitable in his theory.
