Neozakonjeni projekt izmena i dopuna Zakonika o građanskom sudskom postupku sačinjen 1872. godine
Unenacted amendments to a Civil Procedure Code prepared in 1872
Abstract
Autor u radu vrši istorijskopravnu analizu projekta izmena i dopuna Zakonika o građanskom sudskom postupku sačinjenog 1872. godine. Originalni tekst nacrta nije sačuvan, ali je njegovu sadržinu moguće u izvesnoj meri rekonstruisati na osnovu dostupnyh izvora - izveštaja komisije Državnog saveta i sudova koji su nacrt pregledali. S obzirom na to da su savetnici i sudije smatrali da je bolje u potpunosti preraditi ceo Zakonik nego usvajati pojedinačne izmene i dopune, projekt je naišao na loš prijem u stručnoj javnosti. Stoga nikad nije stupio na snagu. Ipak, nacrt je značajan jer je predstavljao povod da sudovi, kroz kritiku projektovanih rešenja, iznesu svoje stavove o problemima koje u praksi stvara primena pojedinih zakonskih odredaba, i o onima koji bi mogli nastati ukoliko se usvoje predložene izmene. U tom smislu reakcije pravosudnih organa na zakonski projekt su dragocen izvor za upoznavanje sa sudskom praksom o nekim pitanjima parničnog procesnog prava.
Unenacted amendments to a Civil Procedure Code are subject of this paper. Draft consisting of changes and supplements of Civil Procedure Code was prepared by minister of justice and renown Serbian jurist Stojan Veljković in 1872. Veljković consigned his draft to State Council. Thereafter the Council established the Commission to revise the draft on September 13th 1872. The author also sent the draft to courts for consideration on October 28th 1872. Original text of the draft has not been found. Therefore, one is imposed to reconstruct it by relaying upon available sources, i.e. remarks offered by the Commission and courts. The Commission and courts made numerous alterations in the original text of the draft. They also passed a multitude of remarks on contents and style of the drafts articles. Consequently, their conclusion was that an entirely new draft should be written, and Veljkovićs project was definitely rejected. Notwithstanding the rejection, the draft provides valuable material... regarding problems in application of Civil Procedure Code of 1865, as they were pointed out in Commissions and courts remarks.
