Managing Medical Waste : European Legal Regulation and Harmonizing the Legislation of Serbia
Abstract
Upravljanje otpadom (waste management) je sastavni deo opšte politike zaštite
životne sredine Evropske unije. Određivanje šta je „otpad“ složeno je pitanje i
predmet je kako akademskih rasprava, tako i zakonskih formulacija, sudske prakse
i administrativnih odluka. Prema Direktivi EU o otpadu (2008/98/EC): otpad je
svaka materija ili predmet koji vlasnik odbacuje, namerava ili mora da odbaci, u
skladu sa zakonom. U Srbiji je ova oblast regulisana Strategijom upravljanja otpadom
za period 2010–2019. U zakonodavstvu Srbije, medicinski otpad regulisan je
Zakonom o upravljanju otpadom (2009; 2016) i posebno Pravilnikom o upravljanju
medicinskim otpadom (2010). Politika i zakonodavstvo Srbije, u oblasti upravljanja
otpadom, a naročito upravljanja medicinskim otpadom, su velikim delom
usklađeni sa standardima Evropske unije.
Waste management is an integral part of the general EU policy on environmental
protection. Defining “waste” is a complex issue and the subject of academic
debates, as well as legislative provisions and judicial and administrative decisions.
According to the EU Directive (2008/98/European Commission), waste is any matter
or object that the owner discards, plans or must discard, in accidence with
the law. In Serbia this issue is regulated by the Strategy on Waste Management
2010–2019. In the legislation of Serbia, medical waste is regulated by the Law on
Waste Management (2009; 2016) and the Regulation on Medical Waste Management
(2010). The policy and legislation of Serbia on issues of waste management,
and in particular medical waste management is for the most part harmonized with
EU standards.
