Odluke Evropskog suda za ljudska prava i njihov uticaj na domaće zakonodavstvo i praksu

Abstract

Имајући у виду значај Европског суда за људска права како на међуна- родном нивоу, тако и у домаћем законодавству, сасвим је оправдано све веће интересовање за све већим посезањем подношења представки за заштиту права овом Суду. За Европски суда за људска права можемо рећи, имајући у виду проценат извршења његових пресуда, да представља један од најус- пешнијих међународних судова, с тога се у овом тексту разматра однос између Европске конвенције о заштити људских права и домаћег правног система, поступак пред Европским судом за људска права као и утицај праксе Европског суда за људска права на праксу и законодавство у домаћем правосудном систему.

Bearing in mind the importance of the European Court of Human Rights, both at the international level and in domestic legislation, it is quite justified that there is an increasing interest in the increasing commitment to submitting applications for the protection of rights to this Court. For the European Court of Human Rights we can say, given the percentage of execution of its judgments, to be one of the most successful international courts, in this text, the relationship between the European Convention on the Protection of Human Rights and the Domestic Legal System is considered, the proceedings before the European Court of Justice human rights, as well as the impact of the European Court of Human Rights practice on practices and legislation in the domestic justice system.
