Unapređenje sistema javnih nabavki u cilju poboljšanja poslovnog okruženja

Abstract

У Србији је у погледу система јавних набавки углавном спрове- ден процес усклађивања националних прописа са правним тековина- ма ЕУ, што би требало да се доврши наредне године. Међутим, да би овај систем омогућио реализацију кључног принципа постизања „највеће вредности за јавна средства“, обезбедио квалитетно и континирано пружање јавних услуга, одржив развој Републи- ке Србије и уштеде при трошењу јавних средстава, од кључног је значаја начин на који се оне спроводе у пракси. У том циљу, веома је важно обезбедити правилно формулисање услова за доделу угово- ра, потпуно деловање конкуренције – што подразумева и спречавање тајних споразума, намештања понуда и коруптивних радњи, прин- цип јавности, али исто тако и уважавање принципа одрживости са аспекта постојеће и будућих генерација. У садејству ових принципа, огледа се и могућност и простор за вршење дискреционе оцене и креативности наручилаца из јавног сектора.

In terms of the public procurement system, Serbia mainly carried out the process of harmonization of national legislation with the EU acquis, which should be completed next year. However, in order for this system to enable the realization of key principles to achieve “best value for public money”, to provide quality and continual delivery of public services, sustainable development of the Republic of Serbia and the savings in the spending of public funds, crucial is to provide appropriate way for its implementation in practice. To this end, it is important to provide the correct formulation of the conditions for the award of the contract, fully functioning competition – which includes the prevention of collusion, bid rigging and corruption, the principle of transparency, but also respecting the principle of sustainability in terms of current and future generations. The conjunction of these principles is reflected in the possibility and space for the exercise of discretion and creativity of public sector contracting authorities.
