Rešavanje sporova u sistemu Svetske trgovinske organizacije

Abstract

У овом раду аутори испитују развој, структуру и деловање си- стема решавања спорова у оквиру Светске трговинске организације. Критички су размотрене кључне фазе овог поступка: консултације, поступак пред панелом, жалбени поступак и поступак извршења препорука и одлука Тела за решавање спрова. Размотрена је улога кључних актера у овом поступку: Тела за решавање спорова, пане- ла, Апелационог тела и арбитраже. На основу спроведених анализа аутори закључују да је систем решавања спорова у оквиру Светске трговинске организације један веома специфичан и сложен механизам који је у доброј мери успео да допринесе повећању предвидљивости примене правила међународне трговине и учвршћивању њиховог поштовања.

This paper focuses on the development, morphology and operation of the dispute settlement system established within the World Trade Organization. Critical remarks have been made with respect to the key phases of this system: consultations, panel procedure, appellate procedure and the enforcement of the recommendations and decisions of the Dispute Settlement Body. The authors also examine the role of the main players in the system: the Dispute Settlement Body, panels, Appellate Body and arbitration. On the basis of the analyses conducted, the authors conclude that the dispute settlement system within the World Trade Organization is a very specific and complex mechanism which has contributed, to a large extent, to the increase of predictability of the application of rules governing the international trade and has enhanced compliance with those rules.
