Posledice otvaranja stečaja na arbitražni postupak u pravu Srbije
Effects of bankruptcy upon arbitral proceedings in the Serbian law
Apstrakt
Otvaranje stečajnog postupka nad jednom od strana u arbitražnom postupku dovodi do brojnih praktičnih problema koja nisu rešena na izričit način u okviru srpskog pozitivnog prava. Autori su, imajući u vidu postojeću uporednu praksu i doktrinu, pokušali da na sistematičan način prikažu probleme koji mogu nastati u interakciji arbitražnog i stečajnog postupka i ukažu na potencijalna rešenja koja su konzistentna sa postojećim zakonodavnim okvirom - posebno imajući u vidu Zakon stečaju i Zakon o arbitraži Republike Srbije. U radu je analiziran i razjašnjen odabrani krug problema koji se mogu pojaviti kako u procesnom tako i materijalnom smislu, a koji se odnose na pitanja arbitrabilnosti, mogućnosti za paralelno vođenje stečajnog i arbitražnog postupka i povezane procesne praznine koje postoje ili se mogu javiti u srpskom pravu.
Opening of bankruptcy proceedings over one of the parties to the pending arbitration opens up numerous practical problems that remain unresolved within the current framework of Serbian legislation. Bearing in mind that key procedural aspects of the possible interaction between these diverging proceedings are not explicitly covered by the applicable statutes, the existing international and comparative practice as well as doctrinal writings on the topic have shaped the motivation of the authors to address selected issues in this troublesome relationship between the bankruptcy and arbitration from the standpoint of Serbian law. The analysis of the issues covered - from the perspective of applicable Serbian Bankruptcy and Arbitration Acts - includes delineation of the notion of arbitrability, possibilities of parallel bankruptcy and arbitration proceedings and procedural gaps that may appear or already exist in the context of insolvent party acting as either a claimant or respondent in arb...itration. The paper concludes with summarization of vital problems and their precise identification while addressing possible solutions that would be in line with the applicable laws in the Republic of Serbia.
