AB  - Autor članka predlaže da se u Srbiji polupredsednički sistem organizacije vlasti, koji loše funkcioniše, zameni režimom parlamentarne republike. Parlamentarizam bi prevazišao slabosti sadašnjeg sistema koje se pre svega sastoje u hipertrofiji predsedničke vlasti. Pisac razmatra dva pitanja budućeg parlamentarnog uređenja - izbor šefa države i odnos vlade i parlamenta. Predlozi za uređenje tih ustanova, dati u članku, predstavljaju samo poziv za raspravu o promeni sistema organizacije vlasti, koju pisac smatra neophodnom.
AB  - The author puts forward the idea to replace the existing, ill-functioning semi-presidential form of government in Serbia with parliamentary government. The latter would put an end to the shortcomings of the current form of government, predominantly consisting in hypertrophy of the presidential powers. The author discusses two topics concerning the parliamentary form of government: election of the head of state and the relations between parliament and the cabinet. The authors suggestions regarding the future shape of these institutions in a future parliamentary republic are aimed solely at instigating debate, which he considers indispensable.

AB  - Profesor Mihailo Konstantinović je zajedno sa svojim kolegama, Mihailom Ilićem i Đorđem Tasićem, savetovao predsednika vlade Dragišu Cvetkovića, koji je inspirisan zamislima kneza-namesnika Pavla, posle komplikovanih pregovora postigao sporazum s vođom najjače hrvatske političke stranke Vlatkom Mačekom. Na osnovu tog sporazuma, koji je sklopljen pri samom kraju avgusta 1939. godine, doneta je Uredba o Banovini Hrvatskoj, kojom je ova stekla poseban položaj u jugoslovenskoj kraljevini. Konstantinović je učestvovao u pregovorima kao ekspert i umnogome doprineo formulisanju teksta te uredbe. Namere tvoraca sporazuma, kao i kneza Pavla, težile su načelnom preuređenju države tako što će biti uveden federalizam. Konstantinović se vrlo mnogo angažovao u tom pogledu i sastavio je nacrt uredbe o Banovini Srpskih Zemalja. Političke prilike i rat omeli su ostvarenje takve zamisli, ali se profesor Konstantinović jasno pokazao kao pristalica federativnog uređenja.
AB  - Mihailo Konstantinović, together with his colleagues Mihailo Ilić and Đorđe Tasić, served as counsel to Prime Minister Dragiša Cvetković committed by Prince Regent Pavle to reach an agreement with Vlatko Maček, the leader of the strongest Croatian political party. The August 1939 agreement resulted in the creation of the Banovina of Croatia, which thus obtained special status within the Kingdom of Yugoslavia. Konstantinović took part in the negotiations and significantly contributed to the drafting of the accompanying decree. The intention of the parties to the agreement, in line with the Prince Regents, was in the direction of introducing federalism in Yugoslavia. Konstantinović very much engaged in such efforts and drafted a decree that was to create the Banovina of Serbian Lands. Political circumstances, as well as the war, impeded the implementation of such ideas, but Konstantinović nevertheless proved himself a convinced federalist.

Inconsistent adjudication: A violation of the right to fair trial under the European Convention on human rights

AB  - The ECtHR does not review decisions of national courts of the States Parties to the European Convention. However, it has developed a pattern in its case law to find a violation of the Convention on the grounds that the fair hearing lacked if there was a case law inconsistency at the level of national jurisdiction. The ECtHR case law was settled in a Grand Chamber case against Turkey in 2011. To find a violation under Article 6 of the Convention the ECtHR requires two tests. Firstly, it must establish the existence of a profound and long-standing inconsistency in the domestic case law, and secondly, the ECtHR raises the issue of a mechanism aimed at removing the inconsistency. If the mechanism does not exist, or if it applied ineffectively, the ECtHR finds a violation of human rights. The author suggests the ECtHR should revisit its jurisprudence.
