Paralelna normativna realnost: neformalni poredak korupcije i klijentelizma u Srbiji

AB  - In contemporary Serbia, political and economic elite members systematically break the law with impunity. The paper explains this phenomenon by relying on theory and data from legal theory, sociology, and political science. The behaviour of officials in contemporary Serbia can be explained by analysing complex interactions between state law and informal norms that arise from informal institutions of clientelism and corruption. These norms form a parallel normative order (1) composed of mutual expectations regarding the behaviour of others and consequences for not complying with these expectations. (2) It is based on social and political powers that strengthen informal institutions and the normative order. (3) Norms of this order regulate the behaviour of actors, and (4) they are mutually harmonised, with the norm of loyalty central to the normative order. (5) The parallel normative system suspends state law for political and economic actors who respect informal rules while using mechanisms, rules, and resources of state law to sanction violations of informal norms that are considered crucial for maintaining the informal order. The relation between formal state law and the informal normative order is one of conflict, competition, and parasitisation. To elaborate on these findings, we explain the concepts of informal rules, institutions, and orders, along with an exposition and analysis of typologies of their relations. We then present and analyse empirical research data about corruption and clientelism in Serbia. Finally, based on the theoretical framework and the available data, we conclude that there is ample evidence that a parallel normative order is established and sustained in Serbia.

Legitimacy, Independence and Impartiality: How do Serbian and Croatian Legal Professionals Assess Their Judiciaries?

AB  - Drawing on a 2018 survey on a convenience sample of 716 Serbian and 393 Croatian legal professionals, we assess their attitudes towards Serbian and Croatian judiciaries against their key dimensions: independence, efficiency, quality, and fairness and impartiality. Legal professionals in both countries have little confidence in their judiciary, which we take as a proxy for legitimacy. Hence, both judiciaries are faced with an internal crisis of legitimacy. Respondents also scored judiciaries low on each of the key dimensions, while regression analysis confirmed that these attitudes are strong predictors of legitimacy. The results indicate that apparent differences in historical trajectories have not undermined common post-transitional political struggles over the role of judiciaries.

Why do we wear masks? Legitimacy, trust and norm compliance during pandemic

AB  - Health regulations curbing the spread of the Kovid-19 virus have brought a number of restrictions into our social life, from wearing masks and maintaining physical distance, to the complete abolition of important segments of social life. In doing so, the government has responded to the key risks of a pandemic: the health of individuals and the ability of health systems to care for large numbers of patients. At the very beginning of the pandemic, two notions took shape in the public: that young people are at lower risk than the elderly and the sick, and that they adhere less to epidemiological measures. Using a dana obtained through the survey at a sample of students at the Faculty of Law in Belgrade, I tried to establish the extent to which they comply with the regulations and which factors influence it the most. The results show that a relatively small percentage of respondents regularly comply with health regulations and that most of them are in the ambivalence zone. Compliance with the measures is influenced by the following factors: belief that the measures are justified and effective, that is, agreement with the content of the norms; trust in institutions, and especially trust in experts and doctors; as well as regular media consumption and trust in their objectivity. Social control, that is, moral and legal condemnation for non-compliance with measures, did not prove to be significant. These findings show that in crisis such as this, clear and transparent communication, and the behavior of actors and institutions that instills trust, can ensure voluntary compliance with legal measures.

The perfect silence: An empirical study on how ignorance and lack of critical debate effect the process of enacting tax legislation in Serbia

AB  - In this paper the authors deal with the crucial question of the ability of the Serbian institutions and society to apply adequate scrutiny with respect to the enactment of tax legislation. After providing a description of the current Serbian law-making and public consultations framework, and analyzing the relevance of the transitional nature of the Serbian political environment on the approach to the business of legislating, the authors choose three case studies which lead to the conclusion that it is the lack of even basic knowledge regarding taxation, at the level of the members of parliament and the media, combined with the silence and inertness of Serbian professional circles to participate in public debates on tax policy, that is enabling many questionable norms to enter Serbian legislation without any notable opposition or deliberation. Finally, the authors propose certain measures that could improve the public consultations process.

'Internal’ crisis of judiciary? Attitudes of members of the legal professions in Croatia and Serbia towards judiciaries in their countries

AB  - In this paper we analyze attitudes of members of the legal professions in Croatia and Serbia with regards to the judicial systems - the trust in judicial institutions and satisfaction with their performance. In the first part of the paper we present arguments of the cultural and institutional approach to explaining the foundations of trust in institutions, then define the characteristics of a "good" judiciary in the context of the democratic rule of law, and present the socio-political context of judicial reform in both countries over the last twenty years. In the second, empirical part of the paper we analyze the data collected through the online survey conducted among members of the legal professions in 2018 in Croatia and Serbia. The results from both countries show a low level of trust in judiciary and deep dissatisfaction with the functioning of judiciary on a list of dimensions. Our analysis confirms the link between (dis)trust in institutions and (dis)satisfaction with their work and thus also the assumptions of the institutional perspective on trust. We conclude that the obtained results point to an "internal" crisis of trust in judiciary in both countries, which accompanies the evident "external" crisis of the Serbian judiciary and the latent tensions in and around the Croatian judiciary.

AB  - This article deals with the social accountability activities of civil society organizations in Serbia and Cambodia. In both countries, they emerged with the conceptual and financial support of international development agencies; yet, the outputs were mediated by the social and political contexts. Still, these activities have some joint features: they (1) boost both understanding and awareness rather than solely mobilizing social interests; (2) target the interests of individual citizens rather than the interests of social-based groups or classes; (3) promote state cooperation instead of confrontation and (3) insist on the use of technical policy-related tools and mechanisms instead of political mobilization. The social accountability initiatives analyzed here have followed a policy-not-politics or depoliticized approach. As a consequence, they were ineffective in mobilizing citizens and social groups in a manner that would efficiently demand more accountability. On the other hand, governments contested civil society and appropriated its accountability discourses and strategies in an effort that can be read as an attempt to resist imposing government accountability and rule of law and pacifying present and future civic activism.

AB  - In this article, we analyse the social accountability (SA) mechanisms that have recently been established in Cambodia. These initiatives take place in a socio-political context marked by pervasive neo-patrimonial structures. Our focus is on the strategies implemented by state actors, CSOs and ordinary citizens (mediated by neo-patrimonial structures) - strategies that demonstrate a neo-patrimonial trap into which SA initiatives have fallen, whereby official institutions and accountability lines have been undermined. These strategies are: to focus SA activities on local level authorities who have no means or power to introduce changes in governance or to improve public services, and to allow SA practices to emerge only to the extent that they do not threaten actual authoritarian distribution of power, norms and practices of clientelistic exchange, and the benefits obtained through patron-client relations. As a result, citizens have not been empowered to demand accountability but, paradoxically, have been encouraged to take over some government responsibilities. This, in turn, strengthens the networks of clientelism and patronage. These insights indicate the weak potential of externally-imposed SA mechanisms in an authoritarian and neo-patrimonial setting in which the government is only partly committed to achieving accountability. The findings are based on a two-year study conducted using a combination of qualitative sociological methods and an ethnographic approach.

AB  - Tekst je posvećen uticaju građanskog društva, odnosno, nevladinih orga- nizacija (NVO) na uspostavljanje odgovorne vlasti i u njemu se izlažu rezultati istra- živanja koja su sprovedena u Srbiji i Kambodži tokom 2014. godine. Nalazi istraživanja ukazuju da NVO imaju mali uticaj na uspostavljanje odgovorne vlasti. U obe zemlje uočavaju se strukturne sličnosti u njihovim aktivnostima : one su depolitizovane i bave se javnim politikama, a ne političkom borbom; usmerene su na pojedince, a ne na grupe; bave se informisanjem, a ne mobilisanjem građana; i usmerene su na saradnju, a ne sukob sa vlas- tima. Pored toga, zajedničko ima je i to što ne uspevaju da aktiviraju dve grupe tradi- cionalnih mehanizama: (1) mejnstrim medije i (2) tradicionalne institucionalne meha- nizme koji obezbeđuju odgovornost vlasti. Upravo su to i pretpostavke uspešnog građanskog aktivizma. Prva pretpostavka tiče se tipa građanskog aktivizma. Depoli- tizovane građanske inicijative imaju male šanse da promene odnose moći u društvu i proizvedu političke promene. Druga pretpostavka tiče se institucionalnih mehanizama odgovornost vlasti. Bez tih mehanizama, kao što su nezavisno pravosuđe i slobodni mediji, mala je verovatnoća da će se uspostaviti odgovorna vlast.
AB  - The article deals with social accountability, the role of civil society and nongovernmental organizations (NGOs) in establishing accountable government. I present the results of surveys conducted in Serbia and Cambodia in 2014. Research findings indicate that NGOs have minor impact on the setting up accountable government. In both countries we identified structural similarities: NGOs are depoliticized and deal with public policy, rather than political struggle; they are directed at individuals and not groups; they are dealing with informing, rather than mobilizing citizens; and are focused on cooperation, not conflict with the authorities. In addition, they fail to activate two groups of traditional mechanisms: (1) mainstream media and (2) traditional institutional mechanisms of government accountability. Those are exactly the assumptions for successful civic activism. The first assumption concerns the type of civic activism. Depoliticised civil initiatives have little chance to change the power relationships in society and produce political change. The second assumption relates to the institutional mechanisms for government accountability. Without these mechanisms, such as an independent judiciary and free media, it is unlikely that accountable government will be established.

AB  - In this article, I analyze the role of professionals (as part of the middle classes) and their communities in fostering reforms within the fields of higher education and social protection, and working towards, and supporting, the development of civil society. The analysis is based on the series of studies that explored lawmaking and policy-making processes in the fields of law, employment, social protection, rural development, tax policies and civil society development. The analysis of the work of professional communities, and the course of changes in these fields, indicates that policy networks had a major impact on the public policymaking process. These networks bring together typical representatives of the middle class: professionals, government officials, professional associations, representatives of modern non-governmental organizations, etc. The interests, upon which these networks were based, can be classified into three groups: (1) control of conditions of reproduction of the profession, (2) control of public resources in a given system (which includes, but is not limited to, control of the funding channels) and (3) control of conditions of reproduction of a given system. All these interests have a clear redistributive character, are - in general - focused on the control of public resources and have created an alliance between the middle classes and the elite. Middle classes have participated in the process of making laws and public policies in a way that has deepened the political inequalities, and to phenomena which, by analogy with the process of state capture by the elite, can be recognized as the capture of resources by the middle classes. The analysis points to an important aspect of sluggish social reforms: the lack of enthusiasm among middle classes and professional elite in fostering deep social change which is due to their ideological and redistributive alliances and strategies of "resources capturing."

AB  - Obično se pretpostavlja da je živo građansko društvo pretpostavka demokratije, odgovorne vlasti i vladavine prava. Sledeći ovu pretpostavku, međunarodne razvojne agencije, organizacije građanskog društva, pa čak i vlade, sprovode aktivnosti koje teže da se uspostavi odgovornost vlade prema građanima. U ovom tekstu analiziram takve aktivnosti vodećih srpskih nevladinih organizacija (NVO). Analiza je usmerena na njihovu sposobnost da promene odnose društvene i političke moći da štetu države. Analiza je primarno zasnovana na empirijskim podacima dobijenim dubinskim intervjuima sa predstavnicima ovih NVO. Rezultati pokazuju da se oni bave javnim politikama, a ne politikom kao takvom, to jest, da primenjuju jedan depolitizovan pristup, usmeravajući svoje aktivnosti na pojedince, a ne na društvene grupe i negujući odnose sa državnim institucijama. To ukazuje na njihov mali potencijal da (1) pokrenu širu društvenu mobilizaciju i (2) uspostave jake institucionalne pretpostavke odgovorne vlade. Dostupni podaci ukazuju da srpske NVO imaju mali potencija da ospore moć države i tako doprinesu jačanju odgovornosti vlade i uspostavljanju vladavine prava.
AB  - It is often assumed that vibrant civil society is precondition for democracy, government accountability and rule of law. Following this assumption, international development agencies, civil society organizations and even governments are participating in activities aiming for the social accountability, that is, accountability of governments towards societies. In this article I am analyzing activities of prominent Serbian non-governmental organizations (NGOs) in the field of fostering government accountability. The analysis focuses on their ability to shift the balance of social and political power away from the state. The analysis is primarily based on empirical data collected through a series of in-depth interviews with representatives of NGOs. It reveals that NGOs follow policy-not-politics, that is, a depoliticized approach, that they target individual citizens and not social groups and nurture relationships with state institutions and public officials with whom they cooperate. They demonstrate a weak ability to (1) initiate wider civic mobilization or (2) establish solid institutional preconditions for government accountability. Thus, available data suggests that Serbian NGOs have weak potential to contest power of the state and thus contribute to strengthening government accountability and rule of law.

Legal culture in contemporary Serbia: Structural analysis of attitudes towards the rule of law

AB  - The article analyzes the support for the rule of law among Serbian citizens. The research data show that support for the rule of law depends on the structural socio-economic position of respondents and their position on the transition winners and losers scale i.e., the level of fulfillment of their interests in the new system. There is differentiation among better educated respondents. Those who benefited from the new system recognize the importance of the rule of law. Others, due to their knowledge and understanding of the functioning of the system, are more disappointed and more critical towards it.

AB  - The article analyzes how various societal interests and groups influenced employment and social policies in contemporary Serbia. These policies were shaped under the influence of international actors and current mainstream ideas. However, various societal interests and interest groups have affected them. Using policy network analysis, we identified key actors, their interests and ideological preferences, and the influence they exerted on the employment and welfare policies. The research indicates that the potential for the redistribution of power and resources is a trigger for establishing policy networks. In the field of social welfare we identify a stable policy network connecting various professional groups (from the public sector, academia, and the nongovernmental sector). There was a lack of other social interests in the debate, that is, welfare beneficiaries or civil society pressures that would influence policy process. The policy network was thereby primarily based on clearly identified interests of professional groups, and new welfare policies redefined and improved their professional and social status. In the field of employment policies, there was a lack of societal interests and organized interests groups that would influence policy process and outcomes. No policy network was identified, and obviously key actors in shaping of employment and labor policies (i.e., economic elites) were not even among the direct participants in the process. During the course of the policy reforms, direct and specific redistributive interests of groups that could have benefited from the new policies had mediated various policy inputs and at the end prevailed over the broader ideological frameworks.

AB  - U ovom radu bavimo se uticajem društvenih grupa i njihovih interesa na zakone i javne politike. Predmet analize je novije socijalno zakonodavstvo u Srbiji, a najveća pažnja posvećena je Zakonu o socijalnoj zaštiti iz 2011. godine. Korišćena su dva metodološka pristupa: (1) analiza dokumenata i (2) polustrukturisani intervjui sa ključnim akterima uključenim u kreiranje zakona i javnih politika. Analizom sastava i delovanja mreža usmerenih na kreiranje javnih politika (engl. policy networks) i institucionalnom analizom otkrivamo društvene grupe i interese koji su oblikovali javne politike i zakone koji su predmet analize. Posebna pažnja posvećena je delovanju međunarodnih stručnih zajednica (engl. epistemic communities). U tekstu se, takođe, detaljno analizira uloga ideoloških i redistributivnih dimenzija mreža u formulisanju zakona i javnih politika.
AB  - The article deals with the influence of organized social groups and their interests on laws and public policies. The subject of the analysis is new Serbian social legislation with 2011 Law on Social Protection being the subject of the most detailed analysis. Two methodological tools were used: (1) analysis of documents and (2) semi-structured interviews with key actors involved in shaping laws and public policies. Using policy network and institutional analysis we identify social groups and their interests that shaped welfare policies. Particular attention is devoted to the role and influence of international epistemic communities. In this article we analyze in detail the redistributive and ideological dimensions of policy networks involved in drafting and adoption of laws and public policies that are in the focus of this analysis.

AB  - Predmet ove doktorske disertacije je uticaj društvenih uslova na stvaranje i primenu socijalnog prava u Srbiji, na prelasku iz 20. u 21. vek. U nekoliko poslednjih decenija u oblasti socijalnog prava menjaju se zakoni i javne politike sa dalekosežnim društvenim posledicama. Cilj ovog rada je da u društvenom kontekstu oličenom u dva globalna procesa (globalizacija i post- socijalistička transformacija) identifikuje uticaj društvenih faktora na stvaranje i primenu socijalnog prava. Društveni faktori (determinante) čije dejstvo pratimo jesu država, tržište i vrednosti, a elite i srednji slojevi su akteri čije delovanje i interese analiziramo. Globalizacija je složen društveni proces povećanja međuzavisnosti društava i država. Ona ima značajne socijalne posledice - npr. povećanje konkurencije dovodi do pojave novih socijalnih rizika. Pored dubokih društvenih promena, globalizacija nosi sa sobom novu ideologiju, koju označavamo kao mešavinu (neo)liberalizma i globalizma. Nova ideologija zasnovana je na idejama individualne odgovornosti za blagostanje, smanjenoj ulozi društvene solidarnosti i promenjenim ulogama države, pojedinaca i privatnog sektora u socijalnoj politici, te subordinaciji socijalnih procesa ekonomskoj logici. Usled globalizacije dolazi i do slabljenja kapaciteta i moći nacionalnih država, posebno na periferiji. Mnoge nadležnosti premeštaju se na nadnacionalne (na primer, u sklopu EU integracija) ili regionalne i lokalne nivoe vlasti (u sklopu decentralizacije). Prostor upražnjen povlačenjem države popunjavaju međunarodni akteri. Među njima, za raspravu o socijalnom pravu poseban značaj imaju međunarodne organizacije kao što su Svetska banka, Ujedinjene nacije sa svojim agencijama, bilateralni donatori, međunarodne nevladine organizacije i Evropska unija. Oni imaju sposobnost da aktivno utiču na kreiranje javnih politika i zakona kroz stručnu i finansijsku pomoć (u obliku kredita i donacija) koje daju zemljama u razvoju, pa i Srbiji.
AB  - The subject of this dissertation is the impact of social conditions on the creation and implementation of social rights in Serbia, at the turn of the 20th in 21st century. In the last few decades laws and public policies in the field of social rights are in the process of deep changes with far-reaching social consequences. The aim of this dissertation is to identify the impact of social factors on the creation and implementation of social rights in the social context marked by two global processes (globalization and post-socialist transformation). Social factors (determinants) whose effect we analyze are the state, the market and values, while elites and middle classes are the actors whose activities and interests we analyze. Globalization is a complex social process of increasing interdependences between societies and states. Globalization has significant social consequences– for example, increased global economic competition leads to the emergence of some of the so called new social risks. In addition to profound social change, globalization brings with it a new ideology, to which we refer as a mixture of (neo)liberalism and globalism. The new ideology is based on the ideas of individual responsibility for personal welfare, reduced role of social solidarity, changing roles of government, individuals and private sector in social policy and subordination of social process to economic logic. State capacities and powers of national states are weakened due to globalization, especially in the world periphery. Many responsibilities are moved to the supranational (e.g. integration within the EU) and regional and local levels of government (as part of the process of decentralization). Vacant space that emerged after the retreat of the state was filled in by international actors. Among them, in the field of social rights important roles are played by the World Bank, the UN with its agencies, bilateral donors, international NGOs, and the European Union. They actively influence the creation of public policies and laws through technical and financial assistance (in the form of loans and grants) offered to developing countries, including Serbia.

AB  - U tekstu se analiziraju društvene osnove pravne države u Srbiji. Pravna država se posmatra kao mehanizam za uspostavljanje i održavanje ravnoteže društvenih interesa i moći. Međutim, nema svaka ravnoteža interesa formu pravne države - za to su potrebne određene meta-pravne ideje, od prirodnog do ljudskih prava (u suprotnom, ravnoteža interesa uspostavlja se kroz fleksibilne mehanizme pregovaranja i usklađivanja). Dalje, pravna država, kao i demokratija, zahteva određenu društvenu osnovu - jake i artikulisane društvene interese za uspostavljanje vladavine prava. U savremenom društvenom kontekstu njih nalazimo na tržištu i u srednjim slojevima. Tržišni akteri (preduzetnici i preduzeća) i pripadnici srednjih slojeva štite svoje investicije, razvojne planove, ekonomske i druge interese uz pomoć (samo)ograničavajućih pravila pravne države. Na primeru savremene Srbije, autor ispituje jedan skup indikatora pravne države u vezi sa kontrolom zakonitosti rada državnih organa i nezavisnošću sudstva. Analiza pokazuje da proces uspostavljanja pravne države ometaju: (1) velika uloga države na tržištu, (2) dugotrajan proces transformacije javnih ekonomskih resursa (uključujući i privatizaciju), (3) malobrojni srednji slojevi sa malom društvenom moći i velikom vezanošću za državu i (4) struktura ekonomske elite koja je nastala konverzijom javnih resursa i još uvek je vezana za državne privredne resurse.
AB  - The article deals with the analysis of the social foundations of the rule of law in Serbia. The rule of law in conceived as a mechanism for establishing and maintaining balance of social interests and powers. However, not every balance of interest will result in a rule of law - for that a set meta-legal ideals is needed (from natural law to human rights). Furthermore, the rule of law, as well as democracy, requires certain social foundations - strong and well articulated social interests. In the contemporary social context these are found at the market and in the middle classes. Market actors (firms and entrepreneurs) and members of middle classes protect their investments, development plans, economic and other interest with a set of (self)restraining rules. Using the Serbian example, the author analyses a series of indicators of the rule of law related to the control of the legality of the work of public officials and independence of judiciary. The analysis reveals that the process of establishing the rule of law is obstructed by: (1) large role of the state in the market, (2) long-lasting process of transformation of public economic resources (including privatization), (3) powerless middle classes closely tied to the state, and (4) the structure of the economic elite that was established through a process of conversion of public resources and is still connected to the state economic resources.

abstract = "U tekstu se analiziraju društvene osnove pravne države u Srbiji. Pravna država se posmatra kao mehanizam za uspostavljanje i održavanje ravnoteže društvenih interesa i moći. Međutim, nema svaka ravnoteža interesa formu pravne države - za to su potrebne određene meta-pravne ideje, od prirodnog do ljudskih prava (u suprotnom, ravnoteža interesa uspostavlja se kroz fleksibilne mehanizme pregovaranja i usklađivanja). Dalje, pravna država, kao i demokratija, zahteva određenu društvenu osnovu - jake i artikulisane društvene interese za uspostavljanje vladavine prava. U savremenom društvenom kontekstu njih nalazimo na tržištu i u srednjim slojevima. Tržišni akteri (preduzetnici i preduzeća) i pripadnici srednjih slojeva štite svoje investicije, razvojne planove, ekonomske i druge interese uz pomoć (samo)ograničavajućih pravila pravne države. Na primeru savremene Srbije, autor ispituje jedan skup indikatora pravne države u vezi sa kontrolom zakonitosti rada državnih organa i nezavisnošću sudstva. Analiza pokazuje da proces uspostavljanja pravne države ometaju: (1) velika uloga države na tržištu, (2) dugotrajan proces transformacije javnih ekonomskih resursa (uključujući i privatizaciju), (3) malobrojni srednji slojevi sa malom društvenom moći i velikom vezanošću za državu i (4) struktura ekonomske elite koja je nastala konverzijom javnih resursa i još uvek je vezana za državne privredne resurse., The article deals with the analysis of the social foundations of the rule of law in Serbia. The rule of law in conceived as a mechanism for establishing and maintaining balance of social interests and powers. However, not every balance of interest will result in a rule of law - for that a set meta-legal ideals is needed (from natural law to human rights). Furthermore, the rule of law, as well as democracy, requires certain social foundations - strong and well articulated social interests. In the contemporary social context these are found at the market and in the middle classes. Market actors (firms and entrepreneurs) and members of middle classes protect their investments, development plans, economic and other interest with a set of (self)restraining rules. Using the Serbian example, the author analyses a series of indicators of the rule of law related to the control of the legality of the work of public officials and independence of judiciary. The analysis reveals that the process of establishing the rule of law is obstructed by: (1) large role of the state in the market, (2) long-lasting process of transformation of public economic resources (including privatization), (3) powerless middle classes closely tied to the state, and (4) the structure of the economic elite that was established through a process of conversion of public resources and is still connected to the state economic resources.",
