Europeanization of General Administrative Procedure in Serbia

AB  - Serbia (as well as other countries of the Western Balkan region) recently adopted the new General Administrative Procedure Act (gapa). The drafting and adoption process was strongly influenced by the European Union and its experts from the sigma organization. The paper first analyzes the novelties introduced and improvements made under European influence. The authors then go on to analyze deficiencies of European influence in the drafting process. Two main shortcomings thereof were the false deregulation and debureaucratization of gapa and the 'one- size-fits-all' approach applied in all the countries of the Western Balkan region, in spite of inherent differences in their legal systems. The purpose of the criticism given in the paper is to avoid the same issues in the future, during the process of harmonization of Serbian law with the acquis communautaire.

AB  - Serbia introduced the Free Access to Information of Public Importance Act (FOIA) (Official Gazette of the Republic of Serbia, no. 120/2004, 54/2007, 104/2009 and 36/2010) in 2004. The right to free access to information in public authorities’ possession has been elevated to a constitutional rank in 2006 (Art. 51, par. 2 of the Constitution) (Official Gazette of the Republic of Serbia, no. 98/2006). Transparency legislation has been completed by enactment of the Personal Data Protection Act (Official Gazette of the Republic of Serbia, no. 97/2008, 104/2009, 68/2012 and 107/2012) and the Secret Data Act (Official Gazette of the Republic of Serbia, no. 104/2009). This also rounded up the competence of the national access to information authority—the Commissioner for Free Access to Information of Public Importance and Personal Data Protection (hereinafter: Commissioner).

The capacity of the Administrative Court in Serbia to deal with asylum cases

AB  - This paper explores the capacity of the Administrative Court in Serbia to adjudicate asylum cases, which have been in its jurisdiction since the Court's establishment in 2010. The analysis of its asylum case law is divided into three phases, based on both temporal and substantive criteria. It demonstrates that the best period in handling asylum cases was 2014-2015, during which judgments of the Court significantly improved the decision-making of administrative authorities. Nevertheless, this research has identified several issues that have negatively influenced the work of the Administrative Court in the field of asylum law: the Court's excessive inherited caseload, the influx of new claims, a small number of asylum-related cases, the insufficient number of judges, the extremely broad jurisdiction of the Court, as well as a lack of specialized panels within the Court. The last problem is identified as the major one and the authors propose concrete steps that should be undertaken in order to increase the capacity of the Administrative Court to deal with asylum cases. Lessons learned from Serbia, as a country in the middle of the Western Balkan migration route, can be useful for all other countries along it.

The Institution of Local Ombudsman in the Republic of Serbia - Success Story or Missed Opportunity?

AB  - The authors analyze the position and competencies of local ombudsmen in the Republic of Serbia, which exist in 22 cities and municipalities. They argue that the basic problem for the slow expansion of this institution can be found in its non-mandatory character and unwillingness of local political elites to be subjected to independent oversight in their work. This problem can be overcome by adopting a separate Law on Local Ombudsmen, which would systemically regulate their mandatory status, the procedure they conduct, as well as ensure further guarantees of their independence, in particular those of financial nature.

AB  - Autor se u radu bavi pitanjem mogućnosti legalizacije neformalnih romskih naselja u Republici Srbiji. Prednacrt Zakona o legalizaciji održivih neformalnih romskih naselja, koji je izradila grupa eksperata 2014. godine, trebalo bi da stvori pretpostavke za ozakonjenje pojedinačnih objekata u ovakvim naseljima u skladu sa nedavno usvojenim Zakonom o ozakonjenju objekata. Autor u radu zastupa stav da novousvjeni zakon ne omogućava stanovnicima neformalnih romskih naselja da ozakone svoje objekte zbog specifične prirode ovakvih naselja (većina njih je izgrađena na zemljištu koje je u javnoj svojini, ili zemljištu čija vlasnička struktura nije jasna i određena). Takođe, mnoga od ovih naselja su izgrađena u suprotnosti sa uobičajenim standardima izgradnje (npr. u vezi sa širinom ulica), što će dodatno da oteža proces ozakonjenja pojedinačnih objekata u njima. Usvajanje Zakona o legalizaciji održivih neformalnih romskih naselja, zajedno sa odgovarajućim pod- zakonskim propisima, rešilo bi prethodno pitanje pravnog statusa zemljišta na kome se nalaze ovakva naselja, a takodje bi doprinelo njihovom uređenju u pogledu kvaliteta izgrađenih objekata i razvoja dodatne infrastrukture. Autor zaključuje da se legalizacija neformalnih romskih naselja ne bi odnosila na sva romska naselja koja se nalaze u Republici Srbiji, već samo ona koja ispunjavanju kriterijume održivosti. Naravno, legalizacija održivih romskih naselja predstavljala bi samo prvi korak i preduslov za dalje unapređenje uslova u kojima Romi žive.
AB  - There have been several attempts of the Government of the Republic of Serbia to legalize structures that have been constructed contrary to its building and land use laws. In spite of all expectations, the results achieved have been insignificant. In order to legalize the highest number of illegally constructed structures and to undertake preventive action against the emergence of new illegal construction, the new Law on the Legitimation of Buildings was adopted in November, 2015. However, the author argues that this act, despite its newly simplified and inexpensive procedure, will not enable the legalization of buildings within informal Roma settlements due to the substandard nature of these settlements (most of which are built on land in public ownership or on land that is of an unregulated or unclear legal status). Therefore, the author advocates a need for the enactment of special Law on the Legalization of Sustainable Informal Roma Settlements as a necessary prerequisite for the subsequent legitimation of individual structures within such settlements.

Prinudno iseljenje i raseljavanje - upravno-pravni aspekti

AB  - Autor se u radu bavi pitanjima prinudnih iseljenja i raseljavanja, prvenstveno sa stanovišta upravnog prava. U radu je detaljno analiziran postupak prinudnog iseljenja koji se vrši na osnovu Zakona o stanovanju, kao i postupak raseljavanja neformalnih naselja koji se sprovodi na osnovu Zakona o planiranju i izgradnji i Zakona o komunalnim delatnostima. Navedena zakonska rešenja ilustrovana su primerima iz upravne i sudske prakse. U radu se konstatuje da je pitanjima prinudnog iseljenja i raseljavanja zajedničko da su adresati upravnih akata, po pravilu, pripadnici ranjivih društvenih grupa, koji su isključeni iz osnovnih socijalnih tokova i koji imaju otežani pristup osnovnim ljudskim pravima. Takođe, u obe situacije se pored navedenih posebnih zakona, supsidijarno primenjuju odredbe Zakona o opštem upravnom postupku, kao opšteg procesnog zakona za rešavanje u upravnim stvarima. Autor zaključuje da kompleksnost, važnost i delikatnost navedenih pitanja, kao i očigledna nedovoljnost postojećeg pravnog okvira, ukazuju na potrebu za donošenjem posebnog zakona, koji bi detaljno regulisao postupak prinudnog iseljenja i raseljavanja.
AB  - In this paper the issues of forced eviction and displacement are analyzed, primarily from the standpoint of administrative law. The author explains the process of forced evictions that have been carried out under the Housing Act and the process of displacement of informal settlements that have been conducted on the basis of both the Law on Planning and Construction and the Law on Communal Activities. Corresponding legal provisions are illustrated by examples from administrative practice and jurisprudence. The author argues that the issues of forced eviction and displacement share a commonality in that the addressees of administrative acts are, as a rule, members of vulnerable social groups who are excluded from basic social trends and who have limited access to basic human rights. Furthermore, in both situations, provisions of the Administrative Procedure Act are implemented as being subsidiary. The author concludes that the complexity, importance, and delicacy of the above questions, as well as the obvious insufficiency of the existing legal framework, indicate the need for the enactment of a special law that would regulate a process of forced evictions and displacements in greater detail.

The author explains the process of forced evictions that have been carried out under the Housing Act and the process of displacement of informal settlements that have been conducted on the basis of both the Law on Planning and Construction and the Law on Communal Activities. Corresponding legal provisions are illustrated by examples from administrative practice and jurisprudence. The author argues that the issues of forced eviction and displacement share a commonality in that the addressees of administrative acts are, as a rule, members of vulnerable social groups who are excluded from basic social trends and who have limited access to basic human rights. Furthermore, in both situations, provisions of the Administrative Procedure Act are implemented as being subsidiary. The author concludes that the complexity, importance, and delicacy of the above questions, as well as the obvious insufficiency of the existing legal framework, indicate the need for the enactment of a special law that would regulate a process of forced evictions and displacements in greater detail.",

AB  - The European Ombudsman investigates complaints about maladministration in the activities of the EU institutions, bodies, offices or agencies, with the exception of the Court of Justice of the EU acting in its judicial role. Cases of maladministration related to the transparency issues are the most common in the European Ombudsman s practice. Therefore, the main goal of this paper is to analyze the role and contribution of Ombudsman in this area, as well as challenges and difficulties which lie ahead in his work. The analysis is largely based on case studies (cases brought by complaints, as well as the Ombudsman s own-initiative inquiries), and on the interpretation of EU legal documents enacted in this area. The principle of transparency is violated when institutions unreasonably refuse to provide information or documents, when they provide misleading or wrong information, and further still when without reasonable explanations they exclude the public from their meetings or consultation process. These issues have been analyzed separately in the paper, due to the complexity of the principle of transparency and a better understanding of its various aspects. The main conclusion of this paper is that, despite numerous difficulties, the European Ombudsman has become a true champion of the principle of transparency within the EU, contributing to the reduction of its democratic deficit and strengthening the legitimacy of its institutions.

AB  - Institucija ombudsmana je tokom druge polovine XX veka doživela ekspanziju, koja se ne može meriti ni sa jednim drugim telom ili institucijom. Ovaj fenomen, kao i karakteristike ombudsmana u različitim zemljama znalački je analizirao profesor dr Slavoljub Popović u svom članku 'Ombudsman u svetu i kod nas'. On je objavljen u zborniku radova sa međunarodnog naučnog skupa 'Ombudsman - zaštitnik prava građana', koji je organizovan 16. i 17. oktobra 1989. godine u Novom Sadu. Profesor Popović je, među brojnim drugim funkcijama, bio i saradnik Odbora za ombudsman Međunarodnog udruženja pravnika (International Bar Association). Rad koji sledi posvećen je sećanju na ličnost i delo profesora Slavoljuba Popovića, čija naučna zainteresovanost za najrazličitije teme iz oblasti Upravnog prava i Nauke o upravi predstavlja primer mlađim generacijama da potpuna posvećenost nauci, ne podrazumeva nužno napor i teškoću ukoliko je praćena velikom ljubavlju prema svom pozivu.
AB  - Institution of Ombudsman during the second half of the twentieth century has experienced an expansion, which cannot be compared with any other body or institution. This phenomenon, as well as characteristics of Ombudsman in different countries ware expertly analyzed by Professor Slavoljub Popović, in his paper 'The Ombudsman in world and our country'. Professor Popović, among many other functions, was also a Fellow of the Committee for Ombudsman of the International Association of Lawyers (International Bar Association). This paper is dedicated to a memory on the person and work of professor Popović, whose academic interest in various subjects of Administrative Law and Science of Public Administration is an example for younger generations that total commitment to science, does not necessarily mean effort and difficulty, if it is accompanied by a great love for this call.
