AB  - Ustavni sud je oglasio neustavnom odredbu čl. 178, st. 3 ZUP, kojom je određen objektivni rok za ponavljanje upravnog postupka. Ustavni sud je utvrdio da je postojanje pomenutog roka neustavno u odnosu na dva od 12 razloga za ponavljanje postupka, konkretno, kad do ponavljanja postupka dolazi usled toga što su Ustavni sud po ustavnoj žalbi ili Evropski sud po predstavci utvrdili da je rešenjem donetim u upravnom postupku povređeno neko Ustavom ili Evropskom konvencijom zajemčeno pravo. Nažalost, odredba čl. 178, st. 3 ZUP propisivala je objektivni rok za svih 12 razloga za ponavljanje postupka. Njenim uklanjanjem je Ustavni sud izašao iz svoje uloge 'negativnog zakonodavca', te umesto zakonodavca izvršio pravno-politički izbor, uklanjajući i delove norme koji nisu nesaglasni sa Ustavom. Autor kritički sagledava predmetnu odluku Ustavnog suda, sa stanovišta njenog obima, njene pravne osnovanosti i njenih posledica. Kritici je podvrgnuta i uloga zakonodavca, koji je propustio priliku da izmeni odnosnu odredbu tokom šest meseci koje mu je na raspolaganju ostavio Ustavni sud.
AB  - The Constitutional Court of Serbia declared Article 178(3) of the General Administra-tive Procedure Act (GAPA) unconstitutional. This provision sets an objective deadline for reopening of the administrative procedure. The Constitutional Court found that this deadline is unconstitutional when the procedure is reopened as a result of the Constitutional Court decision on constitutional appeal or the ECtHR judgment determining that a decision rendered in an administrative proceeding violated a right guaranteed by the Constitution or the European Convention on Human Rights (ECHR). Unfortunately, the said GAPA provision prescribed an objective deadline for other 10 reasons for reopening of the procedure. By declaring this provision unconstitutional, the Constitutional Court stepped out of its role of the 'negative legislator' and made a legislative choice instead of the legislator, by removing par-ts of the norm that are not inconsistent with the Constitution. When making this decision, the Constitutional Court relied on its previous decisions, which removed the same provisions on the objective deadline for reopening of the civil litigation and misdemeanor proceedings. The Constitutional Court ignored the fact that this is an administrative procedure and, erroneously, referred to the inconsistency of the GAPA with the provisions of the Constitution and the ECHR, which guarantee the right to a fair trial, judicial protection and legal remedy. The second, equally unfounded, premise on which the Constitutional Court based its decision is the be-lief that the abolition of the objective deadline for reopening of the administrative procedure was necessary in order to enable the removal of the consequences of violations of the rights determined by the Constitutional Court or the ECtHR. By leaving only a subjective deadline, which is difficult to prove in practice, the level of legal certainty has been lowered. Finally, in its case law, the ECtHR considered that the existence of a limitless possibility of the official removal of final legal acts constituted a violation of Article 6 of the ECHR. The Constitutional Court's abolition of the objective deadline for reopening of the procedure has made this possible.

Administrative law challenges of post-clearance audit in Serbia

AB  - Most imported/exported goods are not controlled by customs authorities at the border. This allows for the fast release of goods and the better functioning of international trade. The backbone of this system consists of customs declarations filed by the importers/exporters, selective control at the border, based on risk assessment, and the post-clearance audit (PCA) of the accepted customs declarations. This paper deals with the questionable practice of the Serbian Customs Administration with regard to the conducting of the PCA, particularly its relation with the Law on General Administrative Procedure and the issues related to the classification of goods according to customs tariff. The author identifies issues regarding the transparency, interpretation and implementation of the PCA in Serbia and contests the (internationally recognized) practice of changing the classification of goods in accepted customs declarations. The author proposes possible solutions for identified challenges.

AB  - Ćutanje uprave postaje sve veći problem u Srbiji. Podaci pokazuju da se broj tužbi protiv ćutanja uprave uvećao 26 puta u poslednjih 10 godina. Uprkos pomenutom povećanju, postoje indicije da se pravna sredstva protiv ćutanja uprave izjavljuju u zanemarljivo malom broju slučajeva u kojima nadležni organi nisu odlučili u zakonom predviđenom roku. Dva moguća razloga za to su neznanje stranaka (većina njih su laici) ili nepoverenje u raspoloživi sistem pravnih sredstava protiv ćutanja uprave. Nažalost, zakonodavac i sudstvo su dodatno pogoršali situaciju. Rad se upravo bavi zakonodavnom i sudskom podrškom ćutanju uprave, koja odvraća stranke od izjavljivanja raspoloživih pravnih sredstava i podstiče ih da se uzdrže od angažovanja advokata. Zakonodavac podržava ćutanje uprave tako što, s jednim izuzetkom, ne dozvoljava strankama da traže naknadu štete pretrpljene usled ćutanja uprave. Upravni sud je podržao ćutanje uprave zauzimanjem pravnog stave prema kojem tužilac nema pravo na naknadu troškova postupka u slučaju kad je podneta tužba protiv ćutanja drugostepenog organa, a prvostepeni organ je zamenio sopstveni ožalbeni akt pre nego što je Upravni sud odlučio o tužbi.
AB  - The administrative silence, as an apparent manifestation of maladministration, has become an ever-increasing problem in Serbia. The number of administrative silence lawsuits submitted to the Administrative Court has increased more than 26 times in the last 10 years. Two potential reasons why the parties do not submit administrative appeals and administrative silence lawsuits to the Administrative Court even more often could be the lack of necessary legal knowledge (most of the parties are lay persons) or their distrust in the available legal protection mechanisms. Unfortunately, the legislator and the judiciary have undertaken measures that further aggravate the situation. This paper discusses two forms of legislative and judicial support to administrative silence, which discourage parties from using legal remedies against administrative silence and engaging lawyers. The legislator effectively supports administrative silence by, save for one exception, preventing parties from claiming damages for the damage they sustained due to the failure of competent administrative authorities to decide in their cases in a timely manner. The Administrative Court supports the administrative silence by a legal stand prescribing that a party is not entitled to reimbursement of the costs of the proceedings, including the costs of lawyer's services, provided that the first-instance administrative authority replaced its act challenged by an administrative appeal before the Administrative Court decided on the administrative silence lawsuit.

Europeanization of General Administrative Procedure in Serbia

AB  - Serbia (as well as other countries of the Western Balkan region) recently adopted the new General Administrative Procedure Act (gapa). The drafting and adoption process was strongly influenced by the European Union and its experts from the sigma organization. The paper first analyzes the novelties introduced and improvements made under European influence. The authors then go on to analyze deficiencies of European influence in the drafting process. Two main shortcomings thereof were the false deregulation and debureaucratization of gapa and the 'one- size-fits-all' approach applied in all the countries of the Western Balkan region, in spite of inherent differences in their legal systems. The purpose of the criticism given in the paper is to avoid the same issues in the future, during the process of harmonization of Serbian law with the acquis communautaire.

AB  - Serbia introduced the Free Access to Information of Public Importance Act (FOIA) (Official Gazette of the Republic of Serbia, no. 120/2004, 54/2007, 104/2009 and 36/2010) in 2004. The right to free access to information in public authorities’ possession has been elevated to a constitutional rank in 2006 (Art. 51, par. 2 of the Constitution) (Official Gazette of the Republic of Serbia, no. 98/2006). Transparency legislation has been completed by enactment of the Personal Data Protection Act (Official Gazette of the Republic of Serbia, no. 97/2008, 104/2009, 68/2012 and 107/2012) and the Secret Data Act (Official Gazette of the Republic of Serbia, no. 104/2009). This also rounded up the competence of the national access to information authority—the Commissioner for Free Access to Information of Public Importance and Personal Data Protection (hereinafter: Commissioner).

AB  - Zakon o opštem upravnom postupku donet je 2016, a počeo je da se primenjuje od 1. juna 2017. godine. Novi zakon je doneo značajne novine i bitno je izmenio koncept prethodnika koji baštini tradiciju dužu od osam decenija. Kako i priliči zakonu takvog značaja i obimu i važnosti novina, novi Zakon o opštem upravnom postupku izazvao je oprečna reagovanja u akademskoj zajednici - od kritika do pohvala. Autor rada, koji je i jedan od autora Nacrta zakona, predlaže izmene tog zakona kojima bi se upravni postupak unapredio. Autor rada nalazi da prostora za poboljšanje ima u odredama koje se tiču garantnog akta, stranke, dostavljanja, prigovora, žalbe i izvršnog postupka.
AB  - General Administrative Procedure Act was enacted in 2016 and started to be applied as of June 1, 2017. The new law brought important novelties and significantly altered the concept of its predecessor, which has tradition longer than eight decades. As it suits the law of such prominence and the scope and importance of the novelties, the new General Administrative Procedure Act provoked contrasting reactions in the academic community - from critique to commendations. The author of the paper (at the same time the one of the authors of the draft law) proposes amendments to the law that could ameliorate the administrative procedure. The author of the paper finds that there is a space for improvement of the provisions concerning the guarantee act, parties, delivery, objection, appeal and enforcement procedure.

AB  - Upravni spor predstavlja jedan od najznačanijih i najsloženijih instituta upravnog prava. Reč je o najvažnijem obliku spoljne kontrole rada uprave. Upravni spor pune jurisdikcije ili puni spor, predstavlja onaj upravni spor u kojem upravnosudska instanca poseduje i ovlašćenja koja se ne svode samo na mogućnost poništavanja određenog akta uprave. Zahvatanje u domen ovlašćenja subjekata uprave je, po pravilu, drugačije, odnosno intenzivnije u odnosu na spor za poništaj upravnog akta. Predmet disertacije je upravni spor pune jurisdikcije. Sadržinski najobimniji deo disertacije posvećen je proučavanju oblika spora pune jurisdikcije u nacionalnim pravima, kako domaćem, tako i uporednim pravnim sistemima. Na osnovu proučavanja razloga nastanka instituta spora pune jurisdikcije, kao i teorijskih shvatanja na ovu temu, formirani su prethodni kriterijumi za prepoznavanje oblika spora pune jurisdikcije u različitim nacionalnim pravnim sistemima. Uporedna zakonodavstva i praksa posmatrani su i proučavani kako autonomno, to jest sa pozicija domaćih teorijskih stavova o postojanju, oblicima i vrstama upravnog spora u predmetnom pravu, tako i uz pomoć seta prethodnih kriterijuma koji su formirani na početku samog istraživačkog poduhvata. S druge strane, sadržinski najvažniji deo disertacije sledi nakon egzegeze uporednopravnih oblika spora pune jurisdikcije. Pisanje tog dela rada ujedno je i cilj samog istraživanja. Premda su prethodni kriterijumi za određenje oblika spora pune jurisdikcije metodološka nužnost, istraživanje poseduje induktivni logički sled. Naime, nakon prepoznavanja oblika spora pune jurisdikcije u uporednom i domaćem pravu, na red dolazi apstrahovanje konkretnih manifestacija u cilju uobličavanja opštijih pojmova – pojma, vrsta i modela spora pune jurisdikcije. Dok doktrina poznaje uporednopravne sisteme i podsisteme, možemo reći modele, upravnog spora, odnosno sudske kontrole uprave, anglosaksonski, evropsko-kontinentalni, engleski i američki, francuski i germanski, i tako dalje, ista se nije bavila izučavanjem i stvaranjem modela spora pune jurisdikcije u uporednom pravu, kao i razvrstavanjem nacionalnih pravnih sistema u ove kategorije. Posebno zanimljivo deo istraživanja predstavlja ispitivanje stepena poklapanja ove dve vrste modela. Drugim rečima, u disertaciji se proverava da li su nacionalni pravni sistemi koji pripadaju određenom modelu upravnog spora, na primer, evropsko-kontinentalnom, uređuju spor pune jurisdikcije na dovoljno sličan način da bi pripadale i istom modelu spora pune jurisdikcije.
AB  - Administrative dispute is one of the most significant and most complex institutes of administrative law. It is the most important form of external control of administration. Administrative dispute of full jurisdiction or full dispute is an administrative dispute in which administrative jurisdiction has powers that are not limited to the possibility of annulment of certain act of administration. Penetration into the field of powers of administrative authorities is, as a rule, different, more intensive than in the dispute for annulment of administrative act. Subject of dissertation is the administrative dispute of full jurisdiction. Most voluminous part of the dissertation is dedicated to examination of forms of dispute of full jurisdiction in national legal systems, both domestic and comparative systems. Prior criteria for recognition of forms of disputes of full jurisdiction in different national legal systems are determined on the basis of analysis of the reasons for creation of the institute of dispute of full jurisdiction and theoretic standpoints on this issue, Comparative legislation and case-law are examined both autonomously, i.e. from the point of view of domestic theories on existence, forms and types of administrative dispute in analyzed legal systems, as well as with the aid of set of prior criteria identified in the beginning of this research. On the other hand, substantially most important part of the dissertation follows exegetic analysis of forms of dispute of full jurisdiction in comparative law. Writing that part of the dissertation presents its main goal. Though prior criteria for determination of forms of dispute of full jurisdiction are methodological necessity, the research has inductive path. Namely, after identification of forms of dispute of full jurisdiction in comparative and domestic law, comes abstraction of particular manifestation with the aim of establishment of more general notions – notion, types and models of dispute of full jurisdiction. While comparative systems and subsystems or, better said, models of administrative dispute, i.e. judicial control of administration, such as Anglo-Saxon, European-Continental, English and American, French and German, etc., exist in legal theory, theorists did not study and create models of dispute of full jurisdiction in comparative law, nor did they classify national legal systems within such categories. Especially interesting part of the research is examination of overlap of these two types of models. Differently put, what is examined in the dissertation is whether national legal systems belonging to a certain model of administrative dispute, e.g. European- Continental, regulate dispute of full jurisdiction similarly enough so as belong to the same model of dispute of full jurisdiction.

AB  - This paper completes the research of the administrative appeal under the Serbian law. It is preceded by two articles containing normative analyses of the general regime of the administrative appeal as prescribed in the General Administrative Proceeding Act and administrative remedies in special policy domains. The main part of the paper is an empirical research concerning the efficiency of the administrative appeal. Efficiency is understood as a precondition for preventing appellants from seeking judicial protection and thus reducing the workload of the court. The remaining part is dedicated to the efficiency of two other administrative legal remedies, as well as to the efficiency of the work of the Ombudsman. The purpose of the latter is to provide material for the consideration of possible amendments to the regime of the administrative appeal, which could enhance its efficiency.

AB  - Registracija javnih glasila je u Srbiji aktuelno pitanje od trenutka kad je Zakon o izmenama i dopunama Zakona o javnom informisanju uveo registar javnih glasila. Ustavni sud Srbije je naknadno utvrdio da navedene odredbe nisu u saglasnosti sa Ustavom. Autor analizira međunarodne standarde i uporednopravna rešenja pitanja na koja je neophodno dati odgovor prilikom uvođenja registra javnih glasila. Najpre, pitanje da li treba uvesti jedinstveni registar za sva javna glasila ili više registara koji će uvažiti razlike koje postoje izmeðu štampanih javnih glasila, radiodifuzije i internet javnih glasila u pogledu legitimnog obima njihove regulacije. Slede pitanja svrhe uvođenja registra, njegovog sadržaja, tj. podataka koji su predmet registracije, tela koje ga vodi i njegovog položaj u odnosu na državnu upravu, kao i sredstava motivacije za upis u registar (sankcije, povlastice). Najzad, razmatraju se alternative uvođenju registra, kojima bi se ostvarila ista svrha. Takođe, kao najčešće proklamovani ciljevi uvođenja registra, u radu se analiziraju i međunarodni standardi i uporednopravna rešenja kojima se obezbeđuje transparentnost vlasništva u medijima i sprečava nedozvoljena medijska koncentracija. U potonjem delu rada sagledavaju se važeća zakonodavna rešenja u Srbiji i razmatraju se mogućnosti za uređenje ove oblasti de lege ferenda, posebno imajući u vidu Strategiju razvoja sistema javnog informisanja u Republici Srbiji.
AB  - The registration of media outlets has been a current issue in Serbia ever since the media register was established by the Act Amending the Public Information Act. The Constitutional Court of Serbia subsequently ruled that respective provisions of that Act were unconstitutional. The author analyzes the international standards and comparative legislative solutions on a number of questions which need to be answered when the media register is being introduced. The first question is whether to introduce a single register for all the media outlets or several registers which would acknowledge the differences between the print, broadcasting and Internet media in terms of the legitimate scope of their regulation. There is also a number of questions concerning the purpose of introducing the media register, its content, i.e. data that shall be registered, the authority which shall keep the register and its status vis-à-vis the public administration, as well as the instruments for encouraging media registration (sanctions, benefits). Further on, the author considers the possible alternatives to introducing the media register, which may serve to accomplish the same goals. In addition, the author analyzes the international standards and comparative legislation which ensure the transparency of media ownership and prevent the prohibited media concentration, as the most frequently proclaimed aims for media registration. In the final part of the paper, the author examines the Serbian legislation on this issue and discusses the possibilities for de lege ferenda regulation of this matter, especially taking into consideration the Strategy for the Development of the Public Information System in the Republic of Serbia.

AB  - This paper addresses the issues of concept, features and place of the administrative appeal in Serbian administrative law. Special attention is given to the relation between administrative appeal and judicial review of administrative acts. The paper is part of a wider analysis regarding the effectiveness of administrative appeals in the framework of administrative justice on European level, put forward at the EGPA Conference in Toulouse in 2010. The paper is limited to scrutiny of normative aspects of administrative appeal, with the intention to be followed by an empirical research on its effectiveness.

AB  - This paper is preceded by another work on the administrative appeal in Serbian law, as prescribed by General Administrative Proceeding Act. It builds upon that by describing and analyzing the most often modifications made to the general regime of the administrative appeal in various policy areas. It furthermore depicts special administrative control mechanisms, different from the administrative appeal, that exist in the fields of public procurement, education and broadcasting. These two articles should conclude the normative analysis of the system of administrative appeal and its counterpart administrative recourses. Normative analysis should further allow empirical research of the efficiency thereof and enable drawing of conclusions on respective features of the appellate proceeding that provide the best results in protection of the legality and private and public interests.

Strazburški standardi u upravnom sporu

AB  - Ovaj članak se vremenski poklapa sa značajnim organizacionim i zakonodavnim promenama u domaćem upravno-sudskom postupku. Reforma pravosuđa Republike Srbije dovodi do stvaranja Upravnog suda koji će ubuduće presuđivati upravne sporove u prvom stepenu. Radi se i na izradi nacrta novog Zakona o upravnim sporovima. Namera je autora da doprinese ovim značajnim promenama koje imaju za cilj poboljšanje upravno-sudske zaštite prava i sloboda građana i organizacija u našoj zemlji. S tim naumom, autor analizira strazburške standarde i usaglašenost domaćih zakonskih rešenja i sudske prakse u upravnom sporu sa njima. Pod strazburškim standardima podrazumevaju se Evropska konvencija o ljudskim pravima i slobodama, i to čl. 6, koji reguliše pravo na pravično suđenje, kao i preporuke Saveta Evrope u oblasti upravnog prava. Autor u centralnom delu teksta identifikuje neusaglašenosti koje postoje u oblasti prava na pristup sudu (prava na iniciranje postupka pred sudom i prava na pravnu pomoć), privremenih mera, utvrđivanja činjenica u upravnom sporu i izvršenju pravosnažnih sudskih presuda. U zaključku rada, autor daje predloge organizacionih i zakonodavnih izmena kojima bi se uočene neusaglašenosti mogle otkloniti.
AB  - This article follows current important organizational and legislative changes in the domestic administrative-court proceedings (administrative dispute). The ongoing judicial reform in Serbia includes creation of the Administrative Court, which should adjudicate administrative disputes in the first instance. A draft of the prospective Administrative Dispute Act is under development. It is the intention of the author to contribute to the changes aimed at improvement of the administrative-court protection of the rights and freedoms of citizens and organizations in the Republic of Serbia. The author analyzes Strasbourg standards, and the level of harmonization of Serbian legislative solutions and case-law with these standards. Strasbourg standards encompass European Convention on Human Rights - namely, Article 6 of the Convention regulating the right to fair trial, as well as the recommendations of the Council of Europe in the field of administrative law. The author identifies inner inconsistencies in respect of the right to access the court (right to initiate proceedings before a court and right to legal aid), provisional measures, determining facts in the administrative dispute, and execution of final court judgments. In the end, the author proposes organizational and legislative changes, which could be used to eliminate identified inconsistencies.
