A decade of balancing with EU human rights protection: between national and international competences and sources of law, individual and systemic interests

AB  - The path towards establishing and advancing human rights' protection within the EU legal system seemed straightforward a decade ago. With the entry into force of the Lisbon Treaty in 2009, the Charter of Fundamental Rights of the EU became part of primary law, together with a commitment of accession to the European Convention on Human Rights. In 2010, Protocol 14 to the ECHR entered into force, allowing the EU to accede to the ECHR. A draft agreement on accession was finalized thereafter. In 2014, however, the Court of justice of the European Union issued a negative opinion on the draft accession treaty citing perceived threats to autonomy of EU law, competence of the EU and powers of the Court. A year earlier, in February 2013, the CJEU rendered judgments in cases Fransson and Melloni whereby it provided crucial rules for interpretation of clauses 51(1) and 53, respectively, of the Charter. The field of application of the Charter was equated with the scope of EU law. Primacy, effectiveness and unity of EU law, both primary and secondary, were prioritized over human rights and fundamental freedoms recognized by international agreements, including the ECHR, as well as by the Member States' constitutions. The realm of fundamental individual rights remains to this day the decisive grounds for asserting the core principle of EU constitutionality: the autonomy of EU law. Accession to the ECHR remains to this day a proclaimed goal of EU governing bodies, but little palpable progress is being made. Protection of fundamental rights at EU level has remained a point of contention among academics. Some question the very need for its existence, in view of constitutional guarantees by Member States and the ECHR. Others, however, claim that the CJEU sacrificed protection of individuals' rights for the interest of promoting constitutionality of the EU. These critiques seem unwarranted. Article 2 TEU necessitates existence of an efficient mechanism for protection of fundamental freedoms at EU level. Historical examples of political communities built on multi-ethnic, civic model all show necessity of integrating human rights protection at the constitutional level. Constitutionality of the EU has been developing for six decades, for the most part under the guise of autonomy of EU law It requires that primacy of fundamental rights, as guaranteed by EU law, be affirmed both vis-a-vis Member States and international treaties. However, one may not expect that fundamental rights and freedoms within the EU be protected in a uniform and efficient manner unless a system for enforcing such rights andfreedoms is not put in place first.

AB  - U ovom radu se prvenstveno razmatra uloga opštih pravobranilaca Suda Evropske unijeu pravnom okviru Evropske unije posle Lisabonskogugovora. Pomenuta uloga je do sada evoluirala naporedo sa razvojem uloge samog Suda Evropske unije. Nakon kratkog istorijskog uvoda, posebna pažnja jeusmerena na postavljanje opštih pravobranilaca i, na širem planu, na značaj opštih pravobranilaca u arhitekturi pravosuđa Evropske unije nakon Lisabonskog ugovora. Drugo žarište ovog rada usmereno je na utvrđivanje odgovora na pitanje da li su opšti pravobranioci i dalje potrebni, kao i da li će oni ostati potrebni u budućnosti imajući u vidu one izazove za koje je razumno očekivati da će se postaviti pred Sudom Evropske unije. Predmetno promišljanje obuhvata i procenu težine argumenatau prilog i protiv zadržavanja instituta opštih pravobranilaca.
AB  - This paper considers primarily the role of the Advocates General of the Court of Justice of the European Union (CJEU) in the post-Lisbon Treaty environment. That role has so far evolved alongside with the evolution of the CJEU itself. After providing a brief historical overview, the author focuses on the appointment of Advocates General and the composition of their cabinets, and discusses the relevance of the Advocates General in the post-Lisbon judicial architecture of the EU. The latter assumes consideration of the ongoing transformation of the EU judicial system. The second focal point of this paper is a discussion on the question whether Advocates General are still needed, and whether they shall be needed in view of the challenges the CJEU may reasonably be expected to face in the future. The reflection comprises arguments in favor and against keeping the institute of Advocates General within the CJEU structure. Upon balancing the provided arguments, it can be concluded that the mechanism of Advocates General is indispensable to the EU since its ongoing transformation requires constant creation of legal rules. The practice so far has proved the great value of Advocates General for that particular need.

AB  - Most institutions that play crucial role in enforcement of EU law regulating judicial cooperation in criminal matters and police cooperation today had existed before the enactment of the Lisbon Treaty, which transformed the nature of European legislation in that area from intergovernmental to supranational. The Lisbon Treaty afforded judicial cooperation in criminal matters and police cooperation a pronounced idiosyncrasy: the greatest degree of flexibility of Member State participation. The experience gained in applying the mechanism of enhanced cooperation, including the concept of the European public order, contributes to the utility of the entire body of law on judicial cooperation in criminal matters and police cooperation as the new unifying factor of the EU.

AB  - In the Constitution of the Republic of Serbia, international relations are regulated in Article 16. According to the Serbian Constitution, foreign policy rests on generally recognised principles and rules of international law. Ratified international treaties, as well as generally recognised principles and rules of international law, form an integral part of the legal order of the Republic of Serbia and are directly applicable. In order to be a part of the legal order, a ratified international agreement must be in accordance with the Constitution of the Republic of Serbia. The Constitution also stipulates the hierarchy of domestic and international general legal acts. Emphasising the unity of the Serbian legal order, Article 194 also regulates that the Constitution is the supreme legal act. To this effect, all laws and other general legal acts promulgated in the Republic of Serbia must comply with the Constitution and may not contradict ratified international treaties and generally recognised rules of international law. We may conclude that ratified international treaties and generally accepted rules have precedence in relation to domestic legislation, and only the Constitution stands above them in terms of hierarchy.

AB  - The mechanisms applied in rescuing the European Monetary Union since the outbreak of the sovereign debt crisis vary significantly in terms of size of funds, dynamics of application, time horizon for expected effects, etc. A legal perspective on these mechanisms reveals a wide variety of instruments and approaches. The paper suggests the approach which assesses whether the balancing between levels of solidarity and conditionality of assistance on commitment to integration inherent to each of these mechanisms was more important for their development, or the key factor for the design and application of those mechanisms remained the focus on common interests of EMU as a whole.

AB  - Presuda Suda Evropske unije u sporu povodom arbitraže o pogonu 'Moks' iz 2006. godine ima višestruki značaj za tumačenje i razvoj prava Evropske unije. Spor je inicirala Evropska komisija zahtevom da se utvrdi da je Irska, time što je započela arbitražni postupak protiv Ujedinjenog Kraljevstva na osnovu Konvencije UN o pravu mora, povredila isključivu nadležnost Suda Evropske unije za rešavanje sporova u pogledu tumačenja prava EU, da je spor o pravu EU podnela na rešavanje nenadležnom telu, kao i da je prekršila obavezu saradnje. Sud je našao da čak i samo pristupanje EU mešovitom sporazumu čini materiju tog sporazuma delom prava EU. Presudom je potvrđena isključiva nadležnost Suda Evropske unije za sve sporove povodom prava EU. Dužnost lojalne saradnje protumačena je kao ograničenje prava država članica da uživaju prava i vrše obaveze koja imaju po međunarodnom pravu. Zajedničko dejstvo stavova iznetih u presudi dovodi do praktičnog razdvajanja pravnih sistema država članica od prava i obaveza koje te države imaju po međunarodnom pravu, uz učvršćivanje uloge institucija EU kao moćnog posrednika.
AB  - The focus of this paper is on the judgment of the Court of Justice of European Union (CJEU) of 2006 in a case instituted by the European Commission against Ireland over the arbitration that Ireland had initiated against the United Kingdom in relation to the MOX plant in Sellafield, UK, and its manifold importance for interpretation and development of the EU law. As it is shown, the Commission claimed that Ireland, by having instituted arbitral proceedings pursuant to UN Convention on the Law of the Sea (UNCLOS), breached exclusive competence of CJEU for disputes involving EU, that it has thus submitted a dispute involving EU law to a non-competent authority and infringed upon autonomy of EU law, as well as that it has breached duty of cooperation with EU institutions. The analysis of the problem presented is reflected in several aspects: firstly, the judgment upheld the claims of the Commission, and in doing so broadened exclusive jurisdiction of CJEU for adjudicating disputes involving EU law: mere accession of EU to a mixed agreement subsumes the subject matter of that agreement under the concept of EU law; secondly, the judgment for the first time explicitly affirmed exclusive jurisdiction of the CJEU over disputes involving EU in a particular case; finally, the duty of cooperation was interpreted as limiting the power of member states to independently from the EU institutions pursue their rights and obligations under international law. As the paper concludes, the MOX judgment may be regarded seminal due to the synergetic effect of its dicta on decoupling of legal systems of EU member states from their rights and obligations under international law, together with affirmation of EU institutions as a powerful broker between the two realms.

AB  - Učenje o ustavnom pluralizmu smatra se podobnim za razumevanje i praćenje promena same EU i posebno njene pravne prirode. Izvan te specifične svrhe, ustavni pluralizam ima veoma ograničenu primenjivost za dublje razumevanje pravne prirode EU. U istorijskoj perspektivi je teško pronaći primer političke zajednice u kojoj je više ustavnih sistema postojalo naporedo. Razlikovanje evolutivne od revolucionarne ustavnosti izgleda veoma primenljivo na primeru Evropske unije, budući da je samo u slučaju evolutivne ustavnosti moguće postojanje jednog drugog pluralizma - pluralizma ustavnih činilaca. Imajući u vidu arhitekturu Evropske unije, primenljivost modela evolutivne ustavnosti čini se daleko većom od pojma ustavnog pluralizma. Evolutivna ustavnost takođe dozvoljava i podeljenu suverenost, što dalje znači i pojmovno razdvajanje suverenosti od države budući da se EU ne može smatrati državom. Podeljena suverenost ne znači odustajanje od vrednosti demokratske vladavine i odgovorne vlade.
AB  - The doctrine of constitutional pluralism is considered to be an appropriate method for understanding and monitoring changes of the EU itself and, particularly, of its legal nature. Apart from such specific use, constitutional pluralism as a concept has very limited applicability in describing the legal nature of the EU. From a historical perspective, it is difficult to identify a single political community in which several constitutional systems coexisted. The European Union is a fine example of the differentiation between evolutive and revolutionary constitutions, for only in the case of evolutive constitutions is it possible to recognize another type of pluralism - the pluralism of constitutional factors. Considering the overall picture of the European Union, the applicability of the model of evolutive constitutionality seems to be far greater than the usefulness of the concept of constitutional pluralism. The concept of evolutive constitutionality is capable of allowing for the possibility that sovereignty may be divisible. This would also entail a conceptual decoupling of the quality of sovereignty from the concept of state, for it is evident that the European Union may not be regarded as a state. Divisible sovereignty does not amount to abandonment of the values of democratic governance and an accountable government.

The Security Council's targeted sanctions in the light of recent developments occurring in the EU context

AB  - The shift from economic sanctions against whole nations to sanctions targeted at individuals brought a new dimension to the focus of international law: the contradiction between (procedural) standards of human rights protection and the authority of the UN Security Council acting pursuant to the UN Charter Chapter VII. The encounter of the UNSC targeted sanctions with the EU and ECHR system of human rights protection, as articulated in recent ECJ decisions, not only affirms the EU as a gradually appearing sovereign legal system with strong human rights safeguards, but also clarifies the authority of the UNSC with respect to maintaining peace and security in the world.
