AB  - Rad predstavlja prvi korak u kvantifikaciji kategorija robe kod kojih postoji najveći rizik od krivotvorenja prilikom uvoza u Srbiju. U prvom delu prikazujemo metodologiju kvantifikovanja nivoa krivotvorenja, njene prednosti i ograničenja. U drugom delu, utvrđujemo kategorije proizvoda sa najvećom verovatnoćom da će sadržati krivotvorene proizvode prilikom uvoza. Korišćenjem OECD metodologije formiran je GTRIC-p indeks za Srbiju i omogućeno poređenje sa zemljama članicama OECD. Utvrđeno je da se Srbija po strukturi rizičnih kategorija proizvoda ne razlikuje značajno u odnosu na zemlje EU. Negativni efekti prouzrokovani su pre svega stranim titularima prava intelektualne svojine, čiji se krivotvoreni proizvodi uvoze u Srbiju. U tom kontekstu i pored uređenog pravnog okvira postavlja se pitanje podsticaja za njegovu primenu.
AB  - The paper represents the first step in quantifying the categories of goods with the highest risk of being counterfeit during import into Serbia. Firstly, we present a methodology for quantifying the level of counterfeiting, its advantages, and its limitations. Secondly, we determine the product categories most likely to contain counterfeit products. Likewise, by using the OECD methodology, the GTRIC-p indicator for Serbia was formed, enabling comparison with OECD member countries. Based on the results, Serbia does not significantly differ from EU countries in terms of structure and product categories most at risk. The negative effects of imports of counterfeit products are borne mainly by the foreign intellectual property rights holders whose counterfeit products are imported into Serbia. In this context, despite the legal framework in place, incentives for its proper implementation are questionable.

AB  - Predmet ovog rada je inat i inadžijsko ponašanje iz ugla biheviorističke ekonomije. Sprovedena je eksperimentalna studija korišćenjem "miniultimatum igre" sa potpunim informacijama o isplatama i nepovoljnoj spoljašnjoj opciji. Uzorak je formiran od 748 studenata Pravnog fakulteta Univerziteta u Nišu i Pravnog fakulteta Univerziteta u Beogradu. U eksperimentalnom dizajnu "između subjekata", 604 različitih učesnika testirano je u kontrolnoj i eksperimentalnoj grupi. U dizajnu "unutar subjekata", 144 učesnika predstavljalo je "sopstvenu kontrolnu grupu". Glavni nalaz je da postoji statistički značajna veza između spoljašnje opcije i izbora učesnika, pri čemu je oko jedne trećine njih pokazalo inadžijsko ponašanje. Takođe, ustanovljena je statistički značajna razlika između ispitanika iz Beograda i Niša u pogledu pravičnog tretmana, ali ne i razlika u udelu onih subjekata koji su ispoljili inat - bez regionalnih razlika u pogledu inata. Nije utvrđena razlika prema polu u pogledu pravičnog tretmana, ali su osobe ženskog pola u Nišu iskazale statistički neznatno veći nivo inadžijskog ponašanja. Studija otvara vrata daljim istraživanjima sa akcentom na subjekte različitih starosnih grupa i dodatne karakteristike inadžijskog ponašanja.
AB  - The subject of this paper is spite and spiteful behaviour from the point of view of behavioural economics. We conducted an experimental study using a 'mini-ultimatum game' with complete information about payoffs and unfavourable outside option. The sample consists of 748 undergraduate students from the Faculty of Law of the University of Niš and the Faculty of Law of the University of Belgrade. In a between-subjects design, 604 different participants are tested in the control and treatment group. In the within-subjects experiment, 144 subjects served as their own control group. The main finding is that there is a statistically significant relationship between the outside option and the respondents' choice, with roughly one-third of respondents exhibiting spiteful behaviour. Also, we found a statistically significant difference between Belgrade and Niš concerning the insistence on fair treatment, but no difference when examining the share of spiteful respondents-no regional effects on spiteful behaviour. We did not find a difference between gender concerning fair treatment, but females in Niš exhibited weakly significant level of spiteful behaviour. The study opens the door to further research with an emphasis on other subjects aimed at covering different age groups and capturing additional characteristics of the spiteful behaviour.

Kreativne industrije u Srbiji - metodološki pristupi i ekonomski doprinos

AB  - Rad razmatra relativni značaj kreativnih industrija u Srbiji i pruža kritički pregled postojećih metodoloških pristupa koji mogu biti korišćeni radi određivanja doprinosa ovih industrija. Takođe, prikazujemo rezultate doprinosa kreativnih industrija u Srbiji u periodu od 2014. do 2017. godine korišćenjem "užeg" DCMS pristupa ograničenog samo na osnovne kreativne industrije (uži pristup). U radu prikazujemo i dodatna merenja doprinosa kreativnih industrija na osnovu pristupa koji definišemo kao "širi pristup". U 2017. godini uže definisane kreativne industrije doprinele su 3,9 procenata ukupne BDV i 3,7 procenata ukupnog BDP-a, a šire definisane industrije 7,8 procenata i 7,5 procenata, respektivno. Drugi indikatori takođe ukazuju na značaj kreativnih industrija u Srbiji. Prosečna godišnja stopa rasta broja privrednih subjekata u okviru užeg pristupa merenju kreativnih industrija iznosi 5,6 procenata (8,4 procenta za širi pristup, što je za 6 procentnih poena više od prosečne stope rasta u celoj ekonomiji - 2,01 procenat). Lica zaposlena u uže definisanim kreativnim industrijama čine 3,3 procenta ukupnog broja zaposlenih lica u Srbiji (šire definisane kreativne industrije doprinose ukupnom nivou zaposlenosti sa 5,6 procenata). Podsektor IT, softverskih i računarskih usluga ima najveći udeo kada je u pitanju doprinos pojedinačnih sektora kreativnih industrija srpskoj privredi. U 2017. godini, ovaj podsektor generisao je više od 60 procenata ukupne BDV uže definisanih kreativnih industrija (više od 55 procenata kada je u pitanju širi pristup klasifikaciji).
AB  - This paper examines the relative importance of creative industries (CI) in Serbia and provides a critical review of the existing methodological approaches that may be used in order to determine the economic contribution of these industries. We also present the results for the period from 2014 to 2017. To show the relative contribution of creative industries, we used the narrow DCMS approach that focuses only on core creative industries. We also provide additional results for what we refer to as the "broad approach". In 2017, narrowly defined CIS contributed 3.9 percent to the total GVA and 3.7 percent to the total GDP, while the broadly defined CIS contributed 7.8 percent and 7.5 percent, respectively. Other indicators provide additional support regarding the importance of CIS in Serbia. The average annual growth rate of the number of narrowly defined CI entities amounts to 5.6 percent (8.4 percent for broadly defined CIS which is 6 percentage points higher than the average growth rate in the national economy - 2.01 percent). Employees engaged in narrowly defined CIS represent 3.3 percent of the total number of employees in Serbia (5.6 percent in the broadly defined CIs). IT, software and computer services subsector contributes the most of all CIS to the economy. In 2017, this subsector contributed more than 60 percent to the total narrowly defined CI GVA, (more than 55 percent to broadly defined CI GVA).

AB  - The subject of this paper is the contrast effect in negotiations from the behavioral economics perspective. We conducted an experimental study using a "divorce litigation game" with complete information about payoffs aimed at testing whether participants are prone to context-dependent decisions. The sample was created by 100 law students from the Faculty of Law of the University of Niš. In a "between subjects" design 100 different participants were tested in the control and treatment group. The main finding is that there is a statistically significant difference between the two groups, thus confirming the presence of the contrast effect. The study opens the door to further real experiments with an emphasis on other subjects, such as lawyers, checking if they are so "rational"

AB  - The paper empirically assesses evidence of bias among bankruptcy judges and predictability of judicial decision making in Serbia. For this purpose, we devised three hypothetical cases that were distributed to judges that preside over bankruptcy cases in Serbia. While the results do not indicate a consistent bias towards either the debtor or the creditor, they show concerning unpredictability of judicial decision making, hence leading to a high level of legal insecurity. Based on responses we observed high heterogeneity among Serbian bankruptcy judges in their interpretation of the bankruptcy laws. This makes allocation of cases to the particular judge a significant determinant for how the debtors and creditors will be treated and how the law will be applied.

AB  - U radu se polazi od hipoteze da prvostepeni sudovi u stečajnim postupcima u skladu sa Unapred pripremljenim planovima reorganizacije (UPPR) često čine propuste koji dovode do ukidanja prvostepenih rešenja o njihovom potvrđivanju. Cilj ovog rada sadržan je u težnji da se kroz analizu razloza ukidanja rešenja o potvrđivanju UPPR-a, najčešći propusti prvostepenog suda prepoznaju, obznane i ukaže na moguće pravce njihovog prevazilaženja. U prvom delu rada polazi se od opštih pravila postupanja suda po predlogu za pokretanje stečajnog postupka u skladu sa UPPR-om. Drugi se deo bavi pitanjem nadležnosti za odlučivanje u drugostepenom postupku i značajem delovanja drugostepenog suda. Treći deorada posvećen je uočenim nepravilnosta u postupanju sudana osnovu empirijske analize. Zaključak razmatra potencijalne posledice sudskog aktivizma u postupcima UPPR-a.
AB  - This paper is based on the hypothesis that the first instance courts in insolvency proceedings in cases in accordance with the pre-arranged reorganization plan (PARP) often make mistakes that lead to their annulement by the appelate court. The aim of this paper is to analyze and describe the most common omissions and indicate possible solutions. The first part provides general rules in accordance with the prearranged plan proceedings. The second part examinesissues related to the decision making on appeal and the roleand the scope of the discretion in decision making of the second instance court. The third part is dedicated to the observed unlawful decisions of the first instance courts and provides an empirical analysis. In conclusion the paperexamines potential consequences of judicial activism in PARP cases.

AB  - Rad razmatra stavove i percepcije poslovnog sektora u Republici Srbiji u pogledu opravdanosti izbegavanja plaćanja poreza i istražuje okolnosti u kojima se poreska evazija smatra prihvatljivom. Na osnovu ankete 1.049 preduzeća i preduzetnika dobijamo robusne rezultate u pogledu uticaja stavova o kompetencijama i radu poreske uprave na poreski moral. Rad analizira podatke koristeći logit model poređanog izbora i parcijalni proporcionalni model izgleda kao bolji pristup. Percepcija rizika otkrivanja neplaćanja poreza, kao i mišljenja o opštoj tolerantnosti poreske evazije u društvu takođe su povezani sa nižim poreskim moralom vlasnika i direktora preduzeća i preduzetnika. Rezultati ukazuju sa je u predstojećem periodu za poboljšanje usklađenosti sa poreskim propisima u Srbiji od izuzetnog značaja da poreske vlasti poboljšaju percepciju i odnos sa poreskim obveznicima sektora preduzeća.
AB  - The paper examines the attitudes and perceptions of Serbian businesses regarding justifiability of tax evasion and assess factors that make tax evasion morally acceptable. Using survey of 1,049 businesses in Serbia, the paper finds strong evidence that the negative evaluation of the tax authorities is associated with lower tax morality. Both the ordered logit model (OLM) and the partial proportional odds model (PPOM) as a desirable alternative to OLM were used in the analysis. The perception of the risk of being caught and the overall tolerance of tax evasion are also associated with lower tax morality of businesses (business owners and managers). Results suggest that in the next period it would be important for the Serbian tax authorities to improve how businesses perceive their activities and significantly improve their perception and relationship with business taxpayers.

AB  - Similar to other countries, Serbia has established an expedited corporate restructuring framework introducing prearranged reorganization plans in the Law on Bankruptcy. New procedure has been widely used since the law came into effect, but with mostly dismal results. The reason for the widespread use lies in the fact that this procedure incorporates all key components of a hybrid procedure-debtor in possession, a moratorium and the possibility to impose the plan on dissenting creditors within the class. As a rule, prearranged reorganization plans are not feasible. Debtors' owners in Serbia are unwilling to give up their equity and despite being unfeasible, creditors tend to support these plans as they are not willing to accept debt write-offs and/or debt-to equity swaps. This article examines the deficiencies of the procedure and suggests further reforms.

AB  - Rad razmatra razloge zbog kojih je uvođenje instituta nametanja plana nesaglasnoj klasi poverilaca (engl. cram-down) u trenutnim okolnostima i u kontekstu stečajne prakse u Republici Srbiji neprimereno i može negativno uticati na efikasnost stečajnog postupka. U prvom delu rad analizira institut 'nametanja plana nesaglasnoj klasi poverilaca' i uslove potrebne za potvrđivanje (usvajanje) plana reorganizacije u uporednom pravu. U drugom delu razmatramo niz faktora koji čine predloženi institut znatno manje potrebnim u našim uslovima, pre svega nizak prag potreban za usvajanje plana, postojeće nametanje plana klasi povezanih lica i vlasnicima stečajnog dužnika, formiranje samo jedne klase razlučnih poverilaca, kao i faktora koji ograničavaju njegovu potencijalnu primenu u stečajnoj praksi.
AB  - This paper discusses possible introduction of the cram-down provisions in the Serbian Law on Bankruptcy and argues that in the current circumstances and taking into account current bankruptcy practice in Serbia, these provisions are inappropriate and could adversely affect the efficiency of the bankruptcy proceedings. In the first part of the paper, we review cram-down in comparative law. The second part looks at a range of factors that make the proposed institute considerably less necessary, including low threshold required for the adoption of the plan, the existing provisions that impose a plan on a class of related persons (and owners), formation of only one class of secured creditors, as well as factors that limit potential application of cram down in bankruptcy practice.

AB  - A shadow economy does not happen by accident. It is a recognised consequence of imperfections in the economic system and inadequacies in economic policy. While the factors that generate and foster the growth of a shadow economy are many and complex, literature considers the following to be the most important: excessive tax burden, government over-regulation of business, and poor performance by government bodies (tax, judiciary, police, and other authorities). Identifying the fundamental causes of a shadow economy is a precondition for designing efficient instruments and policy measures to tackle it. The aim of this chapter is to review the main causes of the shadow economy in Serbia. For this purpose we divided the causes of the shadow economy into: causes rooted in the tax system; causes linked to labour market institutions; other institutional and economic causes; and causes present in the financial sector. We analysed these causes using, wherever possible and appropriate, elementary theoretical analysis, comparative data, views held by social partners on how institutions operate, and the results of the Survey on Conditions for Doing Business in Serbia.

AB  - Research to date on the shadow economy in South Eastern Europe and beyond has mainly focused on macro assessments of this phenomenon or on the socio-economic characteristics of individuals involved in these activities. There have been far fewer studies analysing the characteristics of businesses engaged in the shadow economy and the factors that drive them to operating informally. This chapter provides an analysis of the shadow economy in the business and entrepreneurial sectors using data from the Survey on Conditions for Doing Business in Serbia. This analysis is based on three indicators: (1) the share of business entities engaged in the shadow economy in the total number of business entities; (2) the share of informal workers in the total number of workers, both overall and by type; and (3) the share of cash payments in the total volume of payments. In addition to descriptive statistics that show how the shadow economy varies by key factors, the chapter provides econometric analysis identifying specific factors that are statistically significant in a company's decision to take part in the shadow economy.

AB  - This chapter summarises the main findings of the study and recommendations for formalising the shadow economy. First the chapter outlines the key causes of the shadow economy in Serbia and it then provides an estimate of the shadow economy in relation to GDP, estimates of various forms of the shadow economy in the sectors of businesses and entrepreneurs, and the businesses' and entrepreneurs' characteristics. This leads to an examination of the effects that formalising the shadow economy can have on the government budget and economic growth. The chapter then reviews the findings on the administrative and institutional capacities of the government institutions tasked with overseeing the operation of business entities. The policy recommendations that we propose are a set of preventive measures and incentives aimed at formalising the shadow economy which cover tax policy and regulation, labour market institutions, and the financial sector. The recommendations that entail building the administrative capacity of government bodies relate primarily to the institutions that oversee businesses with informal employees and/or that make and receive cash payments: the Tax Authority, the Labour Inspectorate, and the Market Inspectorate. The final part of the chapter provides the key recommendations for formalising the shadow economy for each of these areas, their sectoral coverage, the institutions responsible for conducting such measures, and the expected outcomes of their implementation.

Kao ulaznu veličinu koristimo nivo tekućih rashoda lokalnih samouprava, dok na strani izlaznih veličina koristimo indikatore koji opisuju ključne javne usluge lokalnih samouprava. U radu koristimo parametarski pristup merenju efikasnosti. Rezultati pokazuju da primenom stochastic frontier metode, u slučaju kada kontrolišemo uticaj egzogenih ograničenja na ponudu lokalnih javnih usluga, 'prosečna' lokalna samouprava proizvodi javne usluge uz troškove koji su za oko 23 procenta veće u odnosu na najefikasnije lokalne samouprave. Rad sadrži kratak osvrt na dobijene rezultate i putokaz za nastavak istraživanja.
AB  - We examine the extent of inefficiency in a sample of 143 Serbian local self-governments for the year 2012. The input side is described by current expenditures of the local self-governments, and the outputs are describing provision of key public services. We use stochastic frontier approach. Our results reveal that the 'average' local self-government in the Republic of Serbia produces public services i.e. output at costs that are approximately 23 percent higher than the 'best practice' peers; once we control for the exogenous constraints on public service provision. We provide a brief discussion of our results and guidance for future research.

AB  - Članak predstavlja prvu detaljnu ekonometrijsku analizu unapred pripremljenih planova reorganizacije (UPPR) u Srbiji. UPPR daje izuzetne podsticaje i predstavlja poželjnu opciju restrukturiranja za dužnike u finansijskim poteškoćama. Na osnovu u zorka od 97 slučajeva pokazujemo da UPPR ne uspeva da ' filtrira ' dužnike čije poslovanje nije održivo, odnosno ne nalazimo da su dužnici koji podnose UPPR u značajno boljem finansijskom položaju od onih čiji se planovi podnose nakon otvaranja stečajnog postupka. Slabo filtriranje je posledica neadekvatne primene instituta UPPR i pasivnosti poverilaca. U radu razmatramo regulatorni i tržišni pristup rešavanju problema negativne selekcije dužnika koji podnose UPPR.
AB  - The article presents the first detailed econometric analysis of pre­packaged reorganization plans in Serbia. Pre-pack offers tremendous incentives for debtors in financial difficulties making it their preferred restructuring alternative. Using the sample of 97 cases, we show that pre­pack fails to filter out inefficient firms as we find no evidence to suggest that the debtors who file pre-packaged plans are in significantly better financial position than those whose plans are submitted after the opening of bankruptcy proceedings. Filtering failure is a result of the poor implementation of the law and creditors' passivity. We examine regulatory and market approaches for solving the problem of adverse selection of debtors filing a pre-packaged bankruptcy.

AB  - Ovaj rad razmatra proces preraspodele rada i situacije stagnantne nezaposlenosti u zemljama u tranziciji. Cilj ovog rada je da pokaže da nezaposlenost u tranziciji sadrži visok stepen žilavosti pošto zaposleni koji traže posao istiskuju nezaposlene. Osim toga, tvrdim da će rezultat ovoga veoma mnogo zavisiti od strukture, tj. kvaliteta otvorenih radnih mesta u privatnom sektoru, što može da bude u vezi sa odabranom strategijom privatizacije. Ovaj model transformiše teorijski Pisaridesov model ravnoteže u traženju posla u model okruženja pogodan za analizu politike u ekonomijama u tranziciji. Glavna razlika u odnosu na prethodnu literaturu je u tome što ovaj razvijeni model obuhvata i traženje posla na radnom mestu, uz postojanje državnog sektora i heterogenog privatnog sektora. Ovaj model daje dinamiku izlaznih podataka u obliku slova U, te tako nudi mogući odgovor na pitanje o razlogu za nagle padove u izlaznim podacima na početku tranzicije. Uspešna tranzicija tržišta rada je povezana sa planiranjem odgovarajućih socijalnih politika, ali je stvaranje dobrog poslovnog okruženja u najmanju ruku podjednako značajno za postizanje održivog rasta.
AB  - This paper addresses the labor reallocation process and the presence of stagnant unemployment in transition countries. The aim of the paper is to show that transitional unemployment has a high degree of persistence as the employed job seekers crowd out the unemployed. In addition, I argue that the result will heavily depend on the structure i.e. quality of private sector job creation, which can be related to the chosen strategy of privatization. The model transforms the theoretical equilibrium search model of Pissarides to the environment suitable for policy analysis of transition economies. The main difference from the previous literature is that the developed model incorporates the on-the-job search with the existence of the state sector and heterogeneous private sector. The model yields the U shaped dynamics of output, thus offering a potential answer to the question on the reason for steep declines in output at the start of the transition. Successful labor market transition has to do with the design of appropriate social policies but the creation of the good business environment is at least as important for achieving the sustained growth.

AB  - Using panel for 25 countries in transition for the period 1989-1999, we are analyzing variables that are influencing economic growth. Our paper confirms well-known effects of macroeconomic stabilization, initial conditions and reforms on growth, as well as the better explanatory power of reforms comparing the institutional variables. We have determined the dynamics of initial conditions influences, and shown that their effect had vanished in 1998. This explains the fact that most of those countries are under the level of 1989 GDP. Paper shows indirect relationship between growth and democracy through the reforms. Higher level of democratization will provide more reforms, which in the end is positively affecting growth. Net effect of democracy, i.e. political rights and civil liberties, is positive. However, this is the case only for those countries which have sufficient level of reforms and have started creation of economic institutions. In the case when there was only a political transition, there was no guarantee that this transition would help country to faster escape from the transitional shock, but just an opposite, without reforms and economic institution it will negatively influence on GDP.
