је тренутно у надлежности Међународног кривичног суда, а то је
Ситуација у држави Палестини. Фокусирали смо се на захтев тужи-
оца за покретање истраге и његову, по нашем мишљењу, лошу аргу-
ментацију. У раду су обрађене главне тезе захтева, попут питања
да ли је Палестина држава или није и то по којим критеријумима.
Циљ нашег рада јесте анализирање неефикасности овог конкретног
поступка и истицање одређених аргумената који су предочени Суду,
који притом немају добру правничку аргументацију и који у доста
случајева излазе из сфере права и улазе у сферу политике., ituation in the State of Palestine within the International Criminal
Court (ICC). Specifically, our focus lies on the prosecutor’s request under
Article 19(3) for a ruling on the Court’s territorial jurisdiction in Palestine,
which, in our assessment, presents flawed argumentation. Throughout this
analysis, we address key elements of the prosecutor’s request, including the
contentious issue of Palestine’s statehood and the criteria used to determine
it. Our objective is to examine the shortcomings of this legal case and shed
light on the arguments presented before the Court. It becomes evident that
the arguments put forth lack coherence and at times veer into the realm of
politics, departing from a strictly legal standpoint. This paper seeks to
underscore the inefficiency of the case while highlighting the implications
of arguments that stray beyond legal boundaries.",
