Posthumous reproduction: Life after death?

AB  - This paper reviews the issue of posthumous reproduction at the international and domestic levels. The overview covers the legal systems of the United Kingdom, as a country that allows posthumous reproduction, and France, as a country that prohibits posthumous reproduction. Subsequently, Serbian legal provisions, which forbid posthumous reproduction, are analyzed. The provisions are analyzed through the lens of the recent private initiative submitted to Serbian national authorities. Although infertility is a great obstacle in life, the proposed amendments present are one-sided as they mainly focus on fulfilling the individual's wish to become a parent, rather than on creating a legal framework. As a result, and bearing in mind that no consensus has been reached regarding the issue of permissibility of posthumous reproduction, the author determines that Serbian legislator is not at fault-at least for the time being.
AB  - Predmet rada je analiza posthumne oplodnje na međunarodnom i nacionalnom nivou. Autorka analizira pravni sistem Velike Britanije, kao države koja ima permisivni stav prema posthumnoj oplodnji, a potom i pravni sistem Francuske, kao države sa negativnim stavom prema posthumnoj oplodnji. Analizi su podvrgnute i zakonske norme srpskog prava koje zabranjuju posthumnu oplodnju. Zakonske norme sagledane su iz perspektive jedne privatne inicijative koja je upućena nadležnim državnim organima Srbije. Iako autorka razume da neplodnost predstavlja veliku prepreku u životu svakog čoveka, zaključuje da su predložene izmene jednostrane jer se njima zanemaruje činjenica da one treba da budu deo pravnog okvira sa kojim ujedno moraju biti usklađene. Upravo zato, a kako među državama nema konsenzusa o dozvoljenosti posthumne oplodnje, autorka ističe da srpski zakonodavac, u ovom trenutku, ne čini povredu prava pojedinaca propisujući zabranu posthumne oplodnje.

Surrogacy: A biomedical mechanism in the fight against infertility

AB  - This paper reviews the issue of surrogacy. The author analyzes surrogacy and continues by conducting a comparative overview of two legal systems with different approaches to surrogacy. The analysis first looks at the legal system of Russia, as it represents a country that allows all forms of surrogacy, and then that of Germany, as a country with norms prohibiting all forms of surrogacy. In turn, the author reviews Serbian legal provisions, which also forbid all forms of surrogacy. The paper further explores whether there is justification for such legal provisions, i.e., it pinpoints potential problems that could arise if the legal provisions were to be changed. It is concluded that the Serbian legislator has decided to remain silent on this issue, most probably due to the fact that any amendments could raise questions that, at least for the time being, have no clear answers.

AB  - Потреба заштите репродуктивне и продуктивне функције коју
жена има у друштву појавила се почетних година прошлог века као
последица патријархалног модела понашања, класификовања улога у
друштву као типично женских или мушких и занемаривања материн-
ства као специфичног тренутка у животу жене. Данас се заштита
ових функција превасходно повезује са нужношћу постављања закон-
ских норми на начин који гарантује једнак третман и једнаке прилике
женама и мушкарцима, постизањем материјалне и правне једнакости.
Управо су зато теоретичари мишљења да постоји потреба специјали-
зације заштите жена у вези са материнством, усмеравајући је на труд-
нице и младе мајке. Идеја аутора је да овим радом укаже на важност
заштите жена у вези са материнством, истовремено упозоравајући на
одређене недостатке који су присутни у вези са концептом заштите
материнства.
AB  - The need to protect both the reproductive and the productive functions of
women in the society emerged in the beginnings of the past century as a consequence
of patriarchate, classification of roles in the society as being predominantly
male or female as well as of the disregard of motherhood as a specific
period in a women’s life. The need to protect the aforementioned functions in
today’s society is mainly connected to drafting of rules in a form which guarantees
equal treatment and opportunities to both women and men, hence providing
for material and legal equality. Legal scholars are of the opinion that there
is a need to specialize protection of motherhood by focusing on pregnant women
and young mothers. The author intends to present the importance of the protection
of motherhood and at the same time warn about the defaults related to the
concept of protection of motherhood.
