AB  - Kolektivno ostvarivanje autorskog prava je vitalni deo korpusa modernih autorskopravnih sistema. Bez njega se ostvarivanje, pa i postojanje autorskog prava teško može zamisliti. Uprkos tome, u poslednje dve decenije sve se više postavlja pitanje njegove svrsishodnosti u današnjem dobu informacionog društva. Predmet istraživanja je upravo podrobnija analiza određenih aspekata interakcije sistema kolektivnog ostvarivanja autorskog prava i novih prilika u informacionom društvu. Analizom se želi postići dvostruki cilj: teorijski i praktični. Teorijski cilj je da se odgovori na sledeća dva pitanja: I Da li je i pod kojim uslovima sistem kolektivnog ostvarivanja autorskog prava svrsishodan u savremenom dobu informacionog društva? II Koji su mogući svrsishodni pravci daljeg razvoja sistema kolektivnog ostvarivanja autorskog prava u informacionom društvu? Praktični cilj je da se pokaže kako dobijeni teorijski nalazi mogu da se iskoriste u kreiranju i planiranju nacionalne politike razvoja sistema kolektivnog ostvarivanja autorskog prava u informacionom društvu, i to na primeru Srbije. Odgovori na dva teorijska pitanja i rešenje za praktični zadatak se, pri tome, traže kroz prizmu konstrukcije društvenog konteksta, koja je posebno determinisana za potrebe istraživanja, tako da je čine spoljašnji sloj – četiri grupe društvenih faktora (tehnološki, ekonomski, kulturološko-vrednosni i politički) i unutrašnji sloj – autorsko pravo. Sprovedeno istraživanje je dalo naredne odgovore. Kolektivno ostvarivanje autorskog prava je i dalje svrsishodno u informacionom društvu, budući da još uvek postoji dovoljna društvena potreba za njegovim tradicionalnim ulogama i ono te svoje uloge može delotvorno da izvršava. Ipak, kako bi ostalo svrsishodno na duži rok, kolektivno ostvarivanje autorskog prava mora da se razvija, da se reformiše. Mogući svrsishodni pravci daljeg razvoja sistema kolektivnog ostvarivanja autorskog prava razlikuju se među državama zbog razlika koje postoje u njihovim lokalnim društvenim kontekstima. Oni se kreću od privremenog insistiranja na tradicionalnom ustrojstvu, preko umerene reforme (kao najuniverzalnije opcije), do fundamentalne reforme kolektivnog sistema. Na osnovu tih teorijskih nalaza, naposletku su pružene i smernice za planiranje politike daljeg razvoja sistema kolektivnog ostvarivanja autorskog prava u Srbiji.
AB  - Collective management of copyright represents a vital segment of modern copyright systems. Without it, the management and even existence of copyright would be hard to imagine. Despite that, in the course of the last two decades, in the new surroundings of the information society, the question of the purpose/relevance of collective management of copyright has become prevalent. This research aims to provide detailed analysis of particular aspects of the interaction of the existing copyright collective management system and new circumstances in the information society. The analysis is twofold: theoretical and practical. The theoretical aim is meant to answer the following two questions: I Does the system of collective management of copyright have a purpose in the present-day information society and under what conditions? II What are the directions for the appropriate development of collective management of copyright in the information society? The practical aim refers to how the obtained theoretical findings could serve the goal of creating and planning of national policies for the further development of the copyright collective management system, having Serbia as an example. The answers to the two theoretical questions and the practical task are sought by relying on the construction of the social context, specifically made within this research, so that it consists of the outer layer – four groups of social factors (technological, economic, cultural and political) and the inner layer – the copyright law. The conducted research has provided the following answers. Collective management of copyright still has its purpose in the information society. The sufficient social need for the traditional functions of the copyright collective management system still exists. And those functions could be performed effectively by the system. Nevertheless, the copyright collective management system needs to be changed/reformed to remain relevant in the long term. Directions for the appropriate development/changes of the copyright collective management system differ among countries due to differences in their local social contexts. They range from insisting on the traditional system (at least in the short term), and moderate reform (as the most universal option) to fundamental reform. Finally, based on the acquired theoretical findings, guidelines for the planning of the copyright collective management policy in Serbia are provided.

The EU Copyright Exceptions for Text and Data Mining: (Un)suitable Model Solution for the Development of Artificial Intelligence?

AB  - Two copyright exceptions for text and data mining (TDM) have been recently introduced in European Union (EU) law. The first "stronger" exception covers TDM conducted for the narrow purposes of scientific research by research organisations (non-profit or tasked with a public interest mission) and cultural heritage institutions. The second " weaker" exception refers to TDM in general, but the rightholders have the power to opt out from it (and after doing so, to license TDM of their content). These exceptions have become a target of immense criticism concerning their (un)suitability to adequately support further development of artificial intelligence in the European Union. This article offers an overview of both the EU TDM copyright exceptions and the ongoing critical discussions accompanying them. The aim is to determine what lessons and/or guidelines could be drawn from this EU experience for other countries that might be considering the introduction of a TDM copyright exception in their national laws.

AB  - This paper analyses harmonization of the criminal law of the Republic of Serbia with the requirements of the Council of Europe on prevention and combating of violence against women and domestic violence—The Istanbul Convention—ten years after the Republic of Serbia signed it. The focus is on newly introduced criminal offenses (female genital mutilation, stalking, sexual harassment and forced marriage) and implementation of new incriminations in practice. The authors also reviewed the criminal offense of domestic violence, its non-harmonization with the requirements of the Istanbul Convention, observed deficiencies concerning the description of the offense, and its implementation in practice (taking into consideration official statistical data and results of relevant researches). The focus is also on certain legal solutions with relation to criminal-legal respond to violence against women, primarily domestic violence (family-legal and administrative-legal solutions). The goal of the paper is to map the deficiencies and suggest the ways for their overcoming which would be in accordance with the requirements of the Istanbul Convention and provide a better, comprehensive respond to violence against women in Serbia.

The Scope of Author’s Moral Right of Integrity in Serbian Law

AB  - This paper focuses on the scope of the author’s moral right of integrity in Serbian copyright law. The analysis indicates that the Serbian Law on Copyright and Related Rights (LCRR) contains a broad, instructive provision on the moral right of integrity which leaves space for flexible interpretations. Consequently, the Serbian courts are left to deal with the question of potential scope regarding the right of integrity on a case-by-case basis, depending on specific factors of each individual case. In doing so, the courts should stay within boundaries set by the inherent characteristic and nature of this right. They should be careful not to step into the zone of overprotection of the moral right of integrity that easily can happen if the provision(s) of the LCRR are interpreted and applied literally. In the paper it is argued that the protection provided by the right of integrity should not go beyond the protection of the justified (reasonable and acceptable) author’s personal interests related to the preservation of the work’s integrity. Also, it should be ensured that the protection does not unreasonably impede conflicting legitimate interests of other involved stakeholders.

Izuzetak od primene instituta iscrpljenja prava u pravu žiga

AB  - Zakonom o žigovima Republike Srbije izričito je propisano da se pravilo o iscrpljenju prava neće primeniti u slučaju postojanja opravdanog razloga nosioca žiga da se suprotstavi daljem stavljanju u promet robe označene žigom zaštićenom oznakom, posebno ako je došlo do kvara ili druge bitne promene stanja robe posle njenog prvog stavljanja u promet. Predmet rada je upravo analiza predočenog izuzetka od primene instituta iscrpljenja prava u pravu žiga. U radu se nastoji odrediti ratio legis posmatranog izuzetka, kako bi se postavile okvirne smernice za njegovo tumačenje. S tim u vezi, posebna pažnja se posvećuje praksi Suda pravde Evropske unije o razmatranom pitanju. Analiza pokazuje da bi predmetni izuzetak trebalo da se tumači restriktivno, te da mesta za njegovu primenu ima pre svega kada je potrebno sprečiti situacije u kojima bi primena instituta iscrpljenja prava neopravdano narušila ostvarivanje žigom zaštićene funkcije oznake da ukazuje na poreklo robe. Ipak, u određenoj meri Sud pravde Evropske unije čini se odstupa od takvog restriktivnog pravca tumačenja.
AB  - The Law on Trademarks of the Republic of Serbia explicitly stipulates that the rule on trademark exhaustion shall not be applied where there exists a legitimate reason for the trademark holder to oppose further commercialization of the goods, especially if a defect or another fundamental change of condition of the goods has occurred after they have been put on the market for the first time. The paper deals exactly with the presented issue of the exemption from the application of the principle of trademark exhaustion. The paper seeks to determine ratio legis of the observed exemption, in order to outline the guidelines for its interpretation. Bearing that in mind, the particular focus is on the practice of the Court of Justice of the European Union, relevant for the analysed issue. The analysis shows that the subject exemption should be interpreted restrictively and applied when it is necessary to prevent situations in which application of the principle of trademark exhaustion would unjustifiably undermine the achievement of the function of a mark to indicate origin of the goods, as the essential function protected by a trademark right. Nevertheless, the Court of Justice of the European Union interprets, to a certain extent, this exemption differently.

The paper deals exactly with the presented issue of the exemption from the application of the principle of trademark exhaustion. The paper seeks to determine ratio legis of the observed exemption, in order to outline the guidelines for its interpretation. Bearing that in mind, the particular focus is on the practice of the Court of Justice of the European Union, relevant for the analysed issue. The analysis shows that the subject exemption should be interpreted restrictively and applied when it is necessary to prevent situations in which application of the principle of trademark exhaustion would unjustifiably undermine the achievement of the function of a mark to indicate origin of the goods, as the essential function protected by a trademark right. Nevertheless, the Court of Justice of the European Union interprets, to a certain extent, this exemption differently.",

AB  - Током процеса приступања Европској унији (ЕУ) Република
Србија (РС) би требало да усвоји и спроведе правне тековине ЕУ у
области заштите права интелектуалне својине генерално, па тако
и у области колективног остваривања ауторског права и сродних
права (КОП). У складу са тим, предмет рада је анализа три питања
– решења из области КОП у РС и њихове усклађености са правом
ЕУ и то: 1) монопола организација за КОП у областима њихових
специјализација гарантованог Законом о ауторском и сродним пра-
вима (ЗАСП); 2) правила ЗАСП о обавези носилаца права да уступе
организацијама за КОП овлашћења за сва своја ауторска дела, одно-
сно предмете сродних права у оквиру специјализације организација и
3) ослобођења занатских радњи од обавезе плаћања накнаде за јавно
саопштавање музичких дела, интерпретација и фонограма (посебно
узимајући у обзир измене предметног ограничења ауторског права
и сродних права прописане у Нацрту Закона о изменама и допунама
ЗАСП из 2016. године). Анализа показује да посматрана три решења
у праву РС нису усклађена са правом ЕУ, те указује на потенцијалне
правце њихове даље промене/развоја.
AB  - In the course of accession to the European Union (EU), the Republic
of Serbia (RS) should adopt and enforce the EU acquis in the field
of intellectual property protection in general, as well as in the field of
collective management of copyright and related rights (CMR). Having
that in mind, this paper analyses three issues – rules in the field of the
CMR in the RS and the level of their harmonization with EU law. The
following issues are analysed: 1) the monopoly of the organizations for
CMR in the areas of their specialization granted by the Law on Copyright
and Related Rights (LCRR); 2) the rule, envisaged in the LCRR, on the
obligation of right holders to delegate to the organisations for CMR therights within the specialization of organizations; and 3) the relief of craft
businesses from the obligation to pay a remuneration for publicly communicating
musical works, interpretations and phonograms (especially
taking into account the amendments of this limitation of copyright and
related rights foreseen by the Draft Law on Amendments and Addenda
to the LCRR of 2016). The analysis shows that the three examined issues

AB  - Medijacija se često označava kao naročito pogodna za rešavanje sporova iz oblasti intelektualne svojine. Ideja ovog rada jeste da, iz ugla srpskog prava, ispita neka pitanja u vezi sa primenom medijacije za rešavanje sporova iz oblasti intelektualne svojine, sa ciljem da se pokuša utvrditi pod kojim okolnostima će biti realno očekivati da medijacija zameni sudski i druge postupke za rešavanje sporova u toj oblasti. Analiza ukazuje da je za primenu medijacije potrebno pre svega da određeni spor bude medijabilan, a zatim da za strane u tom sporu bude celishodno da ga rešavaju putem medijacije. Kod sporova iz oblasti intelektualne svojine ne tako retko navedeni kriterijumi neće biti ispunjeni. Nezavisno od toga, potencijal medijacije kao metoda za rešavanje sporova iz oblasti intelektualne svojine je čini se i dalje veliki. Stoga, poruka je da treba raditi na razvoju i podsticanju šire primene medijacije za rešavanje sporova iz oblasti intelektualne svojine u Republici Srbiji.
AB  - Intellectual property disputes are often considered as particularly suitable for mediation. The idea of this paper is to examine, from the perspective of Serbian law, certain issues related to the application of mediation for resolution of intellectual property disputes, with the aim of trying to determine under what circumstances it will be realistic to expect mediation to replace court and other dispute resolution procedures. The analysis indicates that mediation, in order to be suitable for resolution of a certain dispute, should meet two criteria. Firstly, a particular dispute should fulfil the criterion of mediability, and secondly, it should be suitable for the parties to solve the subject dispute through mediation. In the case of intellectual property disputes it is not so rare that the mentioned criteria will not be fulfilled. In spite of that, the potential of mediation, as a method for resolution of intellectual property disputes, still seems to be significant. Therefore, the message is that it should be worked on development and promotion of wider application of mediation for resolution of intellectual property disputes in the Republic of Serbia.

AB  - Rad je posvećen analizi pitanja odgovornosti pružalaca usluge omogućavanja pristupa Internetu putem bežične lokalne mreže za povrede autorskog i srodnih prava koje su učinjene korišćenjem predmetne usluge. Najpre se razmatra da li i pod kojim uslovima usluga operatora bežičnih lokalnih mreža može predstavljati povredu autorskog i srodnih prava. Potom se ispituje mogućnost operatora bežičnih lokalnih mreža da se pozovu na ograničenje odgovornosti pružalaca usluga običnog prenosa informacija, kao i domašaj tog ograničenja, s naročitim osvrtom na odluku Suda pravde Evropske unije u predmetu Mc Fadden. Posebno se posmatra stav Suda pravde Evropske unije prema komese operatorima bežičnih lokalnih mreža, uprkos ograničenju odgovornosti, može sudskim putem narediti preduzimanje mere zaštite od povreda autorskog i srodnih prava koja se sastoji od uvođenja lozinke za pristup mreži, s tim da se takva lozinka može otkriti samo licima čiji je identitet poznat. Poruka rada je da prilikom utvrđivanja odgovornosti i nalaganja operatorima bežičnih lokalnih mreža da preduzmu mere zaštite od povreda autorskog i srodnih prava treba voditi računa o zaštićenim interesima operatora i korisnika Interneta, a ne samo o zaštiti prava intelektualne svojine, te težiti uspostavljanju pravedne ravnoteže ovih sukobljenih interesa.
AB  - The paper is dedicated to the analysis of the issue of liability of service providers who provide Internet access via Wireless Local Area Networks (WLAN) for copyright and related infringements made by using their services. First, it has been discussed whether and on what conditions service of the WLAN operators can represent the copyright and related rights infringement. Then, both the possibility of the WLAN operators to refer to the liability limitation foreseen for 'mere conduit' service providers and the scope of the limitation itself are examined, having a particular retrospection to the decision of the Court of Justice of the European Union (CJEU) in the Mc Fadden case. The opinion of the CJEU that the national courts may order the WLAN operators, regardless of the limitation of liability, to implement measure for protection from copyright and related rights infringements which encompasses introducing a password for WLAN access, available only to the person who reveals her/his identity, is analysed specifically. The message of this paper is that, when assessing the liability of the WLAN operators for copyright and related infringements, or ordering the implementation of measures for protection of copyright and related rights, protected interests of Internet users and the WLAN operators should be also taken into consideration, not just the protection of intellectual property rights, thus aiming at striking a fair balance between these conflicting interests.
