<title>Šta je "autoplagijat"?</title>

<summary type="text">Šta je "autoplagijat"?; What is self-plagiarism?
U današnjoj klimi pojačane društvene pažnje u vezi sa plagijarizmom, u globalnoj akademskoj zajednici se kao poseban oblik etički problematičnog ponašanja sve češće označava i praksa autoplagiranja. Ako se za plagijat i može reći da je bio predmet podrobnih pojmovnih analiza, to nije slučaj sa autoplagijatom. Ovaj kratak osvrt ima za cilj pokušaj te vrste. Polazeći od odredbe čl. 25 Kodeksa profesionalne etike Univerziteta u Beogradu, razmatraju se najbitnija obeležja ovog akademskog etičkog prestupa. U preduzetoj pojmovnoj analizi se utvrđuje da se tvorac Kodeksa opredelio da inkriminiše kao etički neprihvatljivu samo užu praksu "duplog objavljivanja" (duplicate or dual publication). Zaključuje se da i u slučaju pribegavanja takvoj praksi ne može biti govora o etičkom prekršaju autoplagiranja ako autor jasno naznači da ponovo objavljuje/upotrebljava vlastiti ranije objavljeni ili na drugi način iskorišćeni rad, odnosno delove rada.; In today's era of heightened sensitivity to plagiarism, self-plagiarism is gaining recognition as a distinct ethical concern within the global academic community. While plagiarism has undergone detailed conceptual analysis, the same cannot be said for self-plagiarism. This concise review seeks to address this gap by examining key aspects of this academic ethical issue, as outlined in Article 25 of the Code of Professional Ethics at the University of Belgrade. Through this conceptual analysis, it becomes apparent that the Code specifically condemns the narrower practice of "duplicate or dual publication" as ethically unacceptable. It is clear that self-plagiarism does not occur when an author transparently acknowledges their intention to republish or reuse their previously published or utilized work, including its constituent parts.

<summary type="text">Koliko košta advokatski pripravnik? - o karakteristikama obavljanja pripravničkog staža u advokatskim kancelarijama u Srbiji; How much for a legal intern?: Internships at law offices in Serbia
Namera rada je da se prikaže položaj advokatskih pripravnika u Srbiji. U prvom delu rada dat je teorijski okvir istraživanja, kao i pregled normativnog položaja advokatskih pripravnika, dok su u drugom delu prikazani metodološki okvir istraživanja i analiza prikupljenih podataka na osnovu odgovora 517 ispitanika. Rezultati istraživanja potvrđuju hipotezu o prenošenju efekata raslojavanja unutar advokatske profesije kao posledice aktuelnih društveno-ekonomskih promena na položaj advokatskih pripravnika, pružajući i uvid u lična iskustva i izazove u vezi sa obavljanjem pripravničkog staža, te navode na preispitivanje pravne regulative kojom su definisani prava i obaveze advokatskih pripravnika.; The aim of this paper is to examine the position of legal interns in Serbia. The first part of the paper provides the theoretical framework for the research, as well as an overview of the normative position of legal interns, whereas the second part presents the methodological framework of the research and analysis of the data collected from 517 respondents. The results of the study confirm the hypothesis that current socio-economic changes have led to the transmission of stratification within the legal profession to the position of legal interns. Additionally, the data provide valuable insights into the experiences and challenges faced by legal interns, which have implications for the review of legal regulations governing their rights and obligations.

<title>Hartʼs judicial discretion revisited</title>

<summary type="text">Hartʼs judicial discretion revisited
The Harvard Law Review recently, for the first time, published Hart’s essay titled “Discretion”. It is a carefully arranged version of the lecture which he gave at Harvard in 1956. This essay fills significant gap in Hart's work concerning judicial reasoning. In my paper attention is devoted to his conception of judicial discretion, its two main types (express and tacit), and his understanding of interpretation and rationality related to Hartian discretion. According to Hart, discretion is a form of decision-making in hard cases, which is rational and to some extent constrained by law. However, because no combination of legal rules and principles, properly interpreted, will always give only one legally right answer, the judge in some cases must resort to non-legal reasons, i.e. exercise discretion. Hart’s insight that the law is not the sole ground for (judicial) decisions suggests that there is something “out there” (in our “practical universe”) that plays a role in the legal “earthly” world, and consequently, in the judicial world as well.

<summary type="text">Između sudstva i advokature - profesionalne preferencije studenata prava u Srbiji; Between the judiciary and advocacy: Professional preferences of law students in Serbia
U ovom radu autorka će se baviti pitanjem profesionalnih preferencija studenata prava, sa posebnim naglaskom na preferencije ka sudijskoj i advokatskoj profesiji. U prvom delu rada dat je prikaz najvažnijih pravničkih profesija u Srbiji, dok su u drugom delu teksta prikazani rezultati kvantitativnog istraživanja sprovedenog na Pravnom fakultetu Univerziteta u Beogradu. U zaključnoj diskusiji autorka će pokušati da sistematizuje dobijene rezultate i da da objašnjenje za rezultate kroz prikaz motiva kojima se studenti rukovode prilikom izbora buduće profesije i kroz poređenje uslova rada u advokatskoj i sudijskoj profesiji.; In this paper, the author will present the issue of professional preferences of law students, with a special emphasis on the preferences towards the judiciary and the advocacy as professions. The first part of the paper presents the most important legal professions in Serbia, while the second part of the text presents the results of quantitative research conducted at the Faculty of Law, the University of Belgrade. In the concluding discussion, the author will try to systematize the obtained results and give an explanation for them by presenting the motives that students are guided by when choosing a future profession and by comparing working conditions in the judicial and attorney professions.
