dc.description.abstractZainteresovanost za audio i video zapise je značajno porasla sa razvojem tehnologije i Interneta. Kako je sadržina tih zapisa raznovrsna, moguće je da se na njima nađe neka činjenica od značaja za dokazivanje. Iz tih razloga aktuelizovalo se pitanje mogućnosti korišćenja audio i video zapisa u krivičnom postupku, mimo preduzimanja posebnih dokaznih radnji, tzv. "amaterski audio i video zapisa". U vezi sa tim, javljaju se brojni teorijsko-praktični problemi: na koji način očuvati zakonitost ovih dokaza, kako ih pribaviti, ali i kako ih izvesti na glavnom pretresu, a posebno imajući u vidu da se sačinjavanjem određenih vrsta audio i video zapisa manje ili više zadire u pravo na privatnost njihovih učesnika, kao i da njihovo korišćenje više nije regulisano Zakonikom o krivičnom postupku. Cilj rada je da se ukaže na uslove pod kojim se audio i video zapisi mogu koristi kao zakonit dokaz, kao i na koji način ih zakonito pribaviti i izvesti na glavnom pretresu. Osnovna hipoteza ovog rada je: Iako Zakonik o krivičnom postupku ne reguliše audio i video zapise kao dokaznu radnju, smatramo da ih je, u velikom broju slučajeva, dopušteno koristiti kao dokaz.sr
dc.description.abstractInterest in audio and video recordings has significantly increased with the development of technology and the Internet. Since the content of these records is diverse, it is possible that some of them can be relevant for criminal proceedings. For these reason, the possibility of using "amateur audio and video recording" in the criminal procedure has actualized, with the exception of Special Investigative Actions. Many theoretical and practical problems have arisen from this question: how to keep the legality of this evidence, how to obtain them, but also how to take them at the hearing, especially considering that certain types of audio and video recording less or more violate the right to private life of their participants, and that their use is no longer regulated by the Code of Criminal Procedure. The aim of the paper is to identify the conditions under which audio and video recordings can be used as lawful evidence, as well as how to legally obtain and take them at the hearing. The basic hypothesis of this paper is: Although the Criminal Procedure Code does not regulate audio and video recording as evidentiary action, we consider that, in a large number of cases, it is permitted to use these recordings as evidence.en
