dc.description.abstractU članku se objašnjavaju pomorske arbitraže, kao vrsta posebnih arbitraža. Pri tome se razmatraju samo glavne osobine pomorskih arbitraža uopšte, po kojima se razlikuju od drugih vrsta arbitraža, bez razmatranja pojedinih institucionalnih pomorskih arbitraža u svetu (npr. Londonska, Njujorška, Pariska). Pomorske arbitraže rešavaju sporove u pomorstvu i u vezi sa njime. Pisac najpre razmatra osnovne slučajeve u kojima se ugovara pomorska arbitraža, kao što je brodarski ugovor, gradnja broda, prodaja broda, sudar, spasavanje ili zajednička havarija. Zatim ukazuje na njihove glavne osobenosti u odnosu na ostale vrste arbitraža (na primer, nepodobnost pravnika za arbitre, dvostepenost), na razlike između common law i kontinentalnih arbitraža, kao i između zapadnih i azijskih arbitraža. Na kraju se ukratko prikazuju pojedine važnije pomorske arbitraže u svetu (na primer, Londonska, Njujorška, Hamburška). U zaključku se ukazuje na značaj pomorskih arbitraža za srbiju i ističe njihovo slabo poznavanje.sr
dc.description.abstractIn this article the author explains maritime arbitrations, as a type of specialized arbitrations. These are arbitrations that solve disputes between participants in maritime activities and related accidents (e.g., collision, general average). At the first place, the author analyses the basic cases where maritime arbitration is contracted, such as charter party, construction of ship, sale of ship, collision, salvage or general average. After that, he points to their main particularities comparing with other types of arbitrations (e.g. exclusion of lawyers, consolidation of procedures), as well as to different way of solving maritime disputes between western and Asian arbitrations. The author also explains the basic differences between common law and civil law arbitrations. He concludes the article by contemplating to the reasons of importance of maritime arbitrations for Serbia.en
