dc.description.abstractSuština upravnopravne grane u savremeno doba je u direktnom susretanju i neposrednom povezivanju opšteg/javnog i pojedinačnog, logikom pravnih pravila pri regulisanju konkretnih odnosa. Oficijelnost, službeno-javni princip državnog delenja, i dispozitivnost, tj. ponašanje koje zavisi od volje stranke, u smislu njene dozirane slobode u upravno-pravnim odnosima, kao dva antipoda u upravno-procesnom pravu - u upravnom postupku i u onom upravno-sudskom (u upravnom sporu) - isprepleteni su i delimično, skoro optimalno uravnoteženi. Da bi se ostvarili i javni i angažovani pojedinačni interesi, i pravda, i pravna sigurnost u jednom razumnom vremenskom razdoblju. Naime, u savremenom upravnom pravu, u njegovoj pravnoj regulativi sistema javnih službi snabdevenih i znanjem i prerogativima vlasti - nema apsolutne oficijelnosti, a ni dispozitivnosti. Po prirodi stvari i svrsi i toku merodavnih pravnih postupaka - a saobraženo položaju i funkcionisanju suda, za razliku od misije i kakvoće javne uprave - automija volje stranaka dominira u upravnom-sudskom postupku, naspram delikatne ali ipak jasne prevage oficijelnosti u čistoj, ortodoksnoj upravnoj proceduri.sr
dc.description.abstractDirect meeting and direct connection of general/public and individual/private interests represent the essence of administrative law in modern times, following the logic of legal rules in regulation of concrete relations. Official initiation of proceeding as a principle of state activity and will autonomy in the meaning of behaviour that depends on the will of the party and its measured freedom in administrative law relations are intertwined and almost optimal balanced in administrative procedure as well as in administrative dispute. In order to realize both public and related individual interests as well as the justice and legal certainty in reasonable time. Namely, in modern administrative law i.e. in the legal regulation of the system of public services that are in the same time competent and holders of power - there is no absolute ex officio institution of procedure or autonomy of the will of the parties. By nature of things as well as the purpose and the flow of applicable legal proceedings will autonomy of the parties dominates in the administrative dispute while official initiation takes the lead in orthodoxy administrative procedure.en
