dc.description.abstract | Javne nabavke imaju enorman značaj sa aspekta zadovoljavanja javnog interesa, interesa privrednih subjekata koji u njima učestvuju, kao i svakog građanina koji koristi pribavljena dobra, usluge ili radove neposredno, ili kroz funkcionisanje određenog naručioca kome su to pretpostavke za uspešno obavljanje poslova i zadataka. Uslovi za realizaciju navedenih ciljeva podrazumevaju pravilno utvrđivanje vrste i obima potreba naručilaca, postavljanje jasnih i opravdanih kriterijuma za odabir najpovoljnije ponude, obezbeđenje realizacije potpuno ravnopravne konkurencije, uz eliminisanje korupcije i nedozvoljenih sporazuma. Pored toga, jedna od ključnih pretpostavki za delotvorno, efikasno, transparentno i nediskriminatorno odvijanje postupaka javnih nabavki je pravilno postavljen sistem kontrole postupaka javnih nabavki, koji omogućava zaštitu prava učesnika koji smatraju da su oštećeni, kao i sprovođenje odredaba o javnim nabavkama u interesu naručilaca i javnosti. Takođe, delotvoran i efikasan institucionalni okvir i pravna sredstva podstiču učešće većeg broja ponuđača, obezbeđuju naručiocima najpovoljnije uslove i jačaju poverenje u sistem javnih nabavki. Polazeći od ovakvih ideja, Direktiva 2007/66/EZ zahteva da države članice obezbede efikasno i brzo preispitivanje odluka naručilaca u skladu sa propisanim uslovima. Ovakav stav zauzeo je i Evropski sud pravde u slučaju Alkatel, smatrajući da je cilj Direktive 89/665/EEC da uspostavi delotvorne i brze procedure za preispitivanje nezakonitih odluka naručilaca u fazi u kojoj je još uvek moguće otkloniti nepravilnosti. Prema tome, mehanizam zaštite prava u postupku javne nabavke bi trebalo da omogući blagovremeno osporavanje svake neregularnosti odluka i radnji naručilaca tokom postupka nabavke. Takođe, to podrazumeva i mogućnost preduzimanja privremenih mera protiv bilo koje odluke naručilaca, uključujući i odluku o dodeli ugovora. Sve ovo povećava zakonitost i transparentnost postupaka, kao i odgovornost službenika za javne nabavke i naručilaca. S druge strane, sistem kontrole ne bi trebalo (neopravdano) da odugovlači postupak i realizaciju ciljeva javnih nabvki i morao bi da onemogući potencijalne zloupotrebe podnosilaca pravnih sredstava. | sr |
dc.description.abstract | At present, the new Public Procurement Act is in the final stage of the legislative procedure. It should complete the process of harmonization with the EU acquis in this area. On the other hand, there is the beginning of the reform of Administrative Disputes Act and laws regulating the status and organization of the administrative judiciary and the status of judges. Measures to improve the protection of rights in public procurement procedures could be divided into short-term ones and long-term ones. First, in order to increase the quality and speedness of decision-making of the Republic Commission, the election of new members should provide greater interdisciplinarity. Also, by increasing the number of judges of the Administrative Court in progress, it could gradually move towards greater specialization of court councils by areas, which would increase the quality and efficiency of decision-making. It is very important to speed up the decision of the Administrative Court, particularly because the lawsuit, as a rule has no suspensive effect, and in essence it is reduced to deciding on the right of the applicant to compensation. In the long term, it is necessary to consider whether to allow the contracting authority (and in which situations) to act as a plaintiff against the decision of the Republic Commission. Then, in the administrative dispute regarding the public procurement procedures (and otherwise), the types and modalities of the interim measures, the position of the respondent authority or the interested party in their decision-making, as well as the legal remedies against interim measures, should be considered. Also, if two levels of decision-making will be introduced in an administrative dispute, consideration should be given to whether and in which situations the appeal should be allowed, taking into account the need for effective decision-making in public procurement. | en |
