dc.description.abstractInformaciono društvo je ambivalentno prema pravu intelektualne svojine. S jedne strane, ono je rezultat tehnološkog i ekonomskog napretka koji je donekle rezultat delovanja prava intelektualne svojine. S druge strane, intelektualna svojina u nekim aspektima počinje da ograničava korisnost raspoloživih tehnoloških mogućnosti informacionog društva. Ukazujući na osetljivost granice između slobode konkurencije i isključivih prava intelektualne svojine, odnosno javnog i privatnog domena, autor stavlja naglasak na javni domen kao kulturni i ekonomski resurs koji dobija novo značenje u savremenim tehnološkim i privrednim uslovima. Nasuprot relativnoj pasivnosti zakonodavca da prilagodi pravo intelektualne svojine novim uslovima, evidentan je proces privatne rekonfiguracije odnosa na tržištu informacija, kojim se javni domen proširuje tako što se titulari prava intelektualne svojine uzdržavaju od vršenja svojih isključivih ovlašćenja. Taj procès ukazuje na potrebu holističkog pristupa inovacionoj politici koja mora da preispita i uskladi tri svoja ključna elementa: stimulativnu nagradu za investiranje u tehnološki i kulturni razvoj, slobodu/ograničenje konkurencije i slobodu/ograničenje pristupa tekovinama razvoja. To je neophodno radi stavljanja prava intelektualne svojine i drugih instrumenata inovacione politike u funkciju društvenog blagostanja.sr
dc.description.abstractThe information society is ambivalent about intellectual property law. On the one hand, it is the result of technological and economic progress that is (to a certain extent) the result of the operation of intellectual property rights. On the other hand, intellectual property in some aspects begins to limit the usefulness of the available technological capabilities of the information society. Pointing to the sensitivity of the boundary between freedom of competition and exclusive intellectual property rights, that is, public and private domain, the author emphasizes the public domain as a cultural and economic resource that is gaining new meaning in modern technological and economic conditions. Contrary to the legislator's relative passivity to adjust intellectual property law to the new conditions, there is a process of private reconfiguration of relationships in the information market, which extends the public domain by the abstention of the holders of exclusive IP rights to exercise. This process points to the need for a holistic approach to innovation policy that must reconsider and reconcile its three key elements: a stimulating reward for investment in technological and cultural development, freedom/restriction on competition, and freedom/restriction on access to the fruits of development. This is necessary in order to put intellectual property law and other instruments of innovation policy in the service of social well-being.en
