dc.description.abstractU ovom radu govori se o odnosu primarnih i sekundarnih normi što je jedan od osnovnih problema teorije pravne norme.Uvodni deo rada govori o praktičnim i teorijskim razlozima koji ovu problematiku čine aktuelnom i značajnom za razumevanje celokupnog pravnog fenomena.U nastavku rada govori se o efektima teorije pravne norme na teorijsko-sadržinskom, lingvističkom, funkcionalnom i strukturalnom planu, pri čemu se posebna pažnja posvećuje strukturalnoj analizi pravne norme. Pri tome, osnovni cilj koji želimo da postignemo je da kroz analizu strukture pravne norme ustanovimo koji sve elementi čine strukturu pravne pojave. U tom pravcu, zalažemo se za jedno modernije rešenje odnosa primarnih i sekundarnih normi, gde su sekundarne norme kao norme koje regulišu ponašanje državnih organa tretirane kao funkcionalno i ontološki važnije od primarnih normi kao normi koje regulišu ponašanje građana.Na kraju govorimo o posledicama ovog shvatanja u odnosu na problem pojma prava, pri čemu pokušavamo da dokažemo kako ovakvo tumačenje odnosa primarnih i sekundarnih normi pokazuje da je osnovni sastojak strukture prava sila a ne norma.sr
dc.description.abstractThe relation between the primary and the secondary norms is the matter stricto sensu belonging to the field of the theory of law norms. However, the importance of this matter is much wider and far-reaching at the theoretical as well as at practical level. Considering the theoretical level, through the relation between the primary and the secondary norms it is possible to get valuable conclusions about the nature of the state and its functions, to consider the relation between law and other normative systems and, the most important of all - which is the main aim of this paperwork - through the relation between the primary and the secondary norms it is possible in theoretically impressive and scruple manner to point out the correspondence between force and normative system at the level of the concept of law, specially if the relation is considered to give broader functional importance to the secondary norms referring to the state institutions. By this comprehension, the theoretical analyze center of gravity has been thrown over from the formal aspects of this law concept to the substantial matter, so that the force becomes not only the guaranty of law norms efficiency but as well as the sole content of the law. We have also tried to demonstrate that the force is being not only one of the law structure ingredients but also ontologically more primal ingredient in comparison with the other elements of this law matter and the ingredient determining the relation between all the other law ingredients and, before all, the ingredient having the axiomatic and normative character (ideological and ideal elements of the law).Considering the practical level, the correct comprehension of the relations between the primary and secondary norms creates the presumptions for adequate theoretical and empirical analyze of each concrete law system towards its logical structure and real applicability, although we have not been dealing with this matter. There is one more reason for this enterprise lying in the fact that this matter has not yet been significantly discussed in our literature. Besides that, the most significant authors in our theory of law have considered the relation between the primary and the secondary norms in traditional manner (R. Lukić) or in a modern manner that we have been inclined in this paperwork, although only indicative.en
