dc.description.abstractPrevozilac morem ili rekom danas je uglavnom kompanija koja, kao pravno lice, svoju delatnost prevoza robe i putnika obavlja preko drugih lica. To su pre svega članovi posade na brodu, ali i druga lica (npr. slagači agenti, skladištari). Oni sa prevoziocem mogu da budu u radnopravnom odnosu ako su kod njega zaposleni, ili u ugovornom odnosu, kada mu, po osnovu ugovora, čine određenu uslugu u vezi sa prevozom (npr. ukrcaj, iskrcaj i slaganje robe, njeno skladištenje, pilotaža i slično). Ukoliko takva lica pričine štetu korisniku prevoza, javlja se pitanje da li prevozilac oštećenom licu (krcatelju ili primaocu) odgovara po istim pravilima kao kada štetu pričini svojim radnjama. Zbog toga se u članku razmatraju pravila odgovornosti prevozioca za sopstvene štetne radnje i za radnje njegovih pomoćnika. Posebno se razmatra ko se sve smatra prevoziočevim pomoćnikom opravdanje i pravni osnov te odgovornosti, radnje pomoćnika za koje prevozilac odgovara, prevoziočevo oslobođenje od odgovornosti i odgovornost samih pomoćnika za štetu. Zaključuje se da naši rečni vozari strože odgovaraju za radnje pomoćnika, nego morski i rajnski vozar. Zbog njihove bolje pravne zaštićenosti u odnosu na konkurentske rajnske brodare, njihova odgovornost bi zakonom trebalo da se ublaži u međunarodnom rečnom prevozu.sr
dc.description.abstractNowadays, a maritime or river carrier mostly is a company, which, as a legal person, carry on its business of transporting of cargo and passengers by other persons. Primarily, those persons are the members of the crew of a ship, but they also can be other persons (for example, stevedores, agents warehousers). They can be the employees of a carrier or independent contractors, when they do to him some service (for instance, shipping loading, stowage, discharging, pilotage, warehousing or alike service). In the case of the loss or damage of a cargo by them, there is a question if the carrier is liable for it and if he is liable under the same rules applicable to a case when he makes a damage by his own actions. That is why this article deals with the carrier liability for his own damageable actions and for the actions of his 'associates'. It is especially explained who is considered as a carrier's 'associate', justification, legal ground for that liability, the actions of the associates for which a carrier is liable exceptions from that liability and liability of associates.en
