dc.description.abstract | U tekstu se analizira ustanova notarijata koja je uvedena u Sloveniji pre petnaestak godina. Autorka ukazuje na najvažnije osobine notarske službe njihov značaj i koristi koje je notarijat pokazao u pravnom sistemu Slovenije, pogotovo u oblasti kompanijskog prava, svojinskopravnim odnosima zemljišnoknjižnoj praksi, u izvršnom postupku, nasleđivanju, međunarodnom pravnom prometu, itd. Značaj notarijata naročito dolazi do izražaja kod važnijih pravnih poslova, za čiju je pravnu valjanost zakonom predviđena obavezna notarska forma. Posebno se skreće pažnja na inovacije koje se očekuju u slovenačkom zakonodavstvu, što bi trebalo da notarijat učini još efikasnijim i korisnijim, naročito u oblasti nasleđivanja, gde se očekuje proširenje nadležnosti notara. Opšta je ocena da se notarijat za relativno kratko vreme veoma čvrsto usadio u pravni poredak Slovenije i da je postao veoma korisna institucija. | sr |
dc.description.abstract | The author offers a comprehensive overview of the role of Civil law notary, or Latin notary, in the Republic of Slovenia. The Civil-law notary is a legal adviser and a person of public confidence; a lawyer of private civil law who is vested as public officer with the authentication power of the State to draft, take, and record legal instruments for private parties and provide legal advice. The author examines the main two types of documents prepared by the notaries: certificates of facts and notarial deeds. In addition to being able to provide legal advice and prepare instruments with legal effect, the Latin notary may keep the archives and deposits of money and documents for the purposes of handing them to a third party, and represent a client in civil and administrative proceedings pertaining to the instruments he had prepared. Although it was introduced before fi fteen years only, the author concludes that the Civil-law notary appears as a very useful institution in Slovenian legal system, and announces its further growth particularly in inheritance law. | en |
