dc.description.abstract | Mada je nerealno očekivati da pravo može da bude lek za ljudsku patnju i da eliminiše pogubna dejstva rata, ono je ipak conditio sine qua non zaštite ljudskih prava. Decu štiti čitav spektar različitih prava za vreme oružanog sukoba koja su grubo zloupotrebljavana i kršena. Iako nesavršen, postojeći korpus međunarodnog prava ima potencijal da bude solidna osnova za stvaranje mehanizama podobnih da se suoče s izazovima koje nameće oružani sukob i zaštita dece za vreme njegovog trajanja, ali je potrebno da međunarodna zajednica izvrši politički pritisak na države koje krše međunarodno priznate standarde. Ovaj rad istražuje koji su glavni mehanizmi da se postigne ovaj cilj i zaključuje da je potrebno zaustaviti nekažnjivost, kako na međunarodnom, tako i na nacionalnom planu, jer pravo u deklarativnoj formi samo po sebi nije dovoljno da obezbedi zaštitu dece i ne može da umanji njihove patnje do kojih dolazi usled oružanog sukoba. | sr |
dc.description.abstract | Children are entitled to a whole range of rights during an armed conflict which are flagrantly abused and violated. Although imperfect, it is inevitable that the existing body of law has the potential to provide the impetus for the creation of the mechanisms sufficient to challenge and deal with the protection of children affected by armed conflict. It is on international community to mobilize political pressure on the states that violate the internationally accepted standards of such protection. The author explores the main mechanisms to achieve this goal, concluding that it is of the utmost importance to end the impunity at both international and national level, as law in its declaratory form is not sufficient for the protection of children, and can not reduce the harm children suffer as a result of an armed conflict. | en |
