Time framework in the new Serbian Civil Procedure Act

dc.description.abstractOsnovni cilj rada je analiza uzroka uvođenja vremenskog okvira kao jedne od važnih osobina novog Zakona o parničnom postupku. Autor analizira efekte prethodnog zakona merene stopom ažurnosti i brojem nerešenih predmeta i ukazuje da su nova rešenja posledica daljeg nastojanja da se obezbedi pravo na suđenje u razumnom roku. U radu se prezentiraju neophodni empirijski podaci o parnicama u sudovima prvog stepena. Zaključuje se da stopa ažurnosti, do uvođenja nove organizacije sudova 2010. godine, pokazuje pozitivan trend, ali i da ogroman broj nerešenih predmeta iz prethodnih godina predstavlja veliki teret za parnične sudove. To je, između ostalog, zakonodavcu ukazalo na potrebu vremenskog ograničenja trajanja parnica u novom zakonskom rešenju na nov način, uvođenjem niza novih mera (po pravilu suđenje od strane sudije pojedinca, dostavljanje i predaja podnesaka uz pomoć novih informacionih tehnologija, mogućnost audio i video snimanja suđenja umesto pisanih zapisnika, efikasniji način izvođenja dokaza veštačenjem, itd.), uključujući i dogovaranje očekivanog vremenskog okvira trajanja spora između sudije i parničnih stranaka. Autor predočava moguće pozitivne i negativne posledice uvođenja vremenskog okvira kao novine u Zakonu o parničnom postupku Republike Srbije.sr
dc.description.abstractAn important novelty in the recent Civil Procedure Act of 2011 deals with introducing time framework set down to terminate civil cases within a reasonable time limit, and to break away from enduring trials. It was among the weakest points of the previous practice. The author analyzes effects of the former Civil Procedure Act of 2004 on clearance rate and its effects to the number of pending cases. Although in a period before 2010 clereance rate has shown a positive trend, a huge backlog of unsolved cases from previous years appears as a big burden for civil courts efficiency. This is why the new idea of time framework was introduced by establishing innovative technical solutions (including single judge trial, audio and video taping of the hearing, more efficient way to obtain expert witness opinion, etc.), including an early consent of all actors of the case (judge and the two parties) about the expected duration of the trial. The author tries to point to positive aspects, along with some deficiencies of the new Act in that respect, and offers some suggestions for improvement.en
