Pravne posledice izjave volje usmerene na raskid ugovora zbog neizvršenja

Abstract

Predmet doktorske disertacije predstavlja određivanje pojma, ali i posledica koje stvaraju neosnovane izjave volje usmerene na raskid ugovora zbog neizvršenja. Tzv. neosnovani raskidi otvaraju niz pitanja, pa stvaraju za našu sudsku/arbitražnu praksu dosta dilema. U pravnim sistemima poput našeg, u kojima se ugovor zbog neizvršenja raskida izjavom volje poverioca, mimo suda, i pred samim poveriocima je ne tako lak zadatak.

The subject of the doctoral dissertation is the definition of the concept, as well as of consequences incurred by unfounded declaration of intention due to failure of performance. The so-called unfounded termination brings fourth a plethora of issues thus creating many a dilemma for the case/arbitration law in this country. In legal systems such as the one in this country , in which the contract, due to failure of performance, is terminated by the creditor`s declaration of intention, the so-called extra-judicial termination, the creditors are faced with by no means an easy task.
