dc.description.abstractU autorskopravnom smislu, svaka upotreba računarskog programa predstavlja umnožavanje ovog autorskog dela, za koje je načelno potrebna izričita saglasnost autora. Ipak, uvažavajući njegove posebnosti iznikle iz njegove tehničko-tehnološke prirode, određena činjenja u vezi s umnožavanjem, koja se smatraju neophodnim za normalnu upotrebu, izuzeta su iz autorsko-pravne zaštite, ukoliko se preduzimaju od strane legalnog pribavioca primerka računarskog programa. Najčešće, pravni osnov korišćenja računarskog programa jeste ugovor o licenci. Polazeći od toga, u ovom radu se analizira da li i do koje mere voljom ugovornih strana može da se derogira volja zakonodavca izražena u odredbama o suspenziji autorskog prava. U centru pažnje su umnožavanja koja se najčešće preduzimaju: instalisanje programa i njegovo puštanje u rad i sačinjavanje rezervne kopije računarskog programa. Uz to, za određene subjekte pitanje dozvoljenog umnožavanja obuhvata i umnožavanje u mreži računara, odnosno upotreba na dva ili više računara, zbog čega se i ovi aspekti uzimaju u obzir. U radu su izneseni zaključci da je dopuštenost instalisanja i puštanja računarskog programa u rad nesporna. Sačinjavanje rezervne kopije je, po pravilu, dozvoljeno, ali postoje okolnosti zbog kojih se u pojedinim slučajevima smatra nepotrebnim, odnosno nedozvoljenim, jer prevazilaze standard normalne upotrebe. Na kraju, umnožavanje računarskog programa u mreži ili njegova istovremena upotreba na više računara se ne smatraju potrebnim za normalnu upotrebu.sr
dc.description.abstractIn terms of copyright, any use of the computer program is a reproduction of copyrighted work, requiring an explicit consent of the author. However, taking into account its special features that arise from its technical nature, certain acts, which are considered necessary for normal use of a computer program, are exempt from copyright protection if undertaken by the legal acquirer of copies of computer programs. Frequently, the legal basis for using the computer program is a license agreement. In that sense, this paper analyzes whether and to what extent the parties can derogate the will of the legislator, expressed in the provisions on suspension of copyright. The focus of this paper is on duplication that is usually taken: installation of the program, running it, and making back-up copies of computer programs. In addition, for certain users, permission for copying and duplication of computer program are very important in the network use, as well as in the use of the program on two or more computes. That is why these aspects are also taken into account. Following the analysis of the issues presented, this paper concludes that the admissibility of computer installation and running the program is undisputed. More over, making back-ups is normally allowed, but there are circumstances under which this is considered unnecessary and illegal. Actually, reproduction seems to be beyond the standard of normal use. Finally, copying of computer programs in the network or its simultaneous use on multiple computers is not considered necessary for its normal use.en
