dc.description.abstractPosebna međunarodna nadležnost za sporove nastale iz ugovornih odnosa se bazira na bliskoj vezi između spora i suda. Predviđena je kao alternativa opštoj nadležnosti s obrazloženjem da omogućuje efikasno vođenje sudskog postupka, ali i ravnotežu procesnih interesa i pozicija tužioca i tuženog. Razmatranje ovog veoma kompleksnog pitanja autor u prvom delu rada bazira na aktuelnoj zakonskoj regulativi EU oličenoj u Brisel I uredbi, a u drugom delu na zakonskoj regulativi Republike Srbije, odnosno na Zakonu o rešavanju sukoba zakona sa propisima drugih zemalja, ali i na radnoj verziji budućeg Zakona o međunarodnom privatnom pravu čije se usvajanje očekuje uskoro. U redosledu pitanja koja obrađuje, autor sledi tekst navedenih izvora i pažnju posvećuje svim onim pitanjima koja su zbog različitog tumačenja otežale primenu odredbe o ovoj vrsti nadležnosti. Tako su u fokusu analize pojmovi ugovorni spor, ugovorna obaveza relevantna za zasnivanje nadležnosti, mesto ispunjenja obaveze o kojoj je reč, mesto isporuke robe, odnosno mesto pružanja usluge, kao i šta se smatra pravilnom primenom novih propisa Srbije harmonizovanih sa komunitarnim tekovinama.sr
dc.description.abstractSpecial jurisdiction in matters of contracts is based on the close link between the cause of action and the territory of the court on which the jurisdiction is conferred. This is exception to the general jurisdiction based on defendants domicile. It is introduced to legal systems with aims to facilitate the sound administration of justice and to make the balance between parties, giving the plaintiff a choice to bring proceedings to a court of his convenience. The structure of special jurisdiction rules contained in Brussels I Regulation is very complex. The general rule disguises more than it reveals at first glance and ought to be read in the light of the previous judgments of the ECJ and special rule is the modernizing element as it introduces an autonomous fact-based concept for the most important categories of contracts. After adoption of the new Serbian Law on International Private Law the rules on special jurisdiction shall be applied in accordance with EU standards, i.e. with ECJ practice.en
