dc.description.abstractRad započinje kratkim osvrtom na tezu o ruskoj državi kao orijentalnoj despotiji, kojom se osporava postojanje načela zakonitosti i ideje o supermatiji prava u bilo kom periodu razvitka ruskog prava. Radi osporavanja te teze, svojstvene zapadnoj društvenoj nauci, u radu se analiziraju ruski pravni spomenici XVI i XVII veka. Najpre, Sudebnik od 1550. godine, kao prvi ruski pravni spomenik koji sadrži propis kojim je državni zakon proglašen za jedini izvor prava i kojim je proklamovana zakonitost postupka pred sudovima i upravom. Pojava načela zakonitosti u ruskom pravu dovodi se u vezu sa velikim društvenim, organizacionim i teritorijalnim promenama koje su zahvatile Moskovsku Rusiju na početku vladavine cara Ivana IV. Istovremeno autor analizira istorijski okvir u kome se načelo zakonitosti javlja u pravu Velike Kneževine Litve, kako bi utvrdio neke opšte zakonitosti u pojavi ideje o supermatiji prava u dva bliska pravna sistema koja su se razvijala pod sasvim drugačijim spoljnim uticajem. Poslednji deo rada je posvećen analizi odredaba prve ruske kodifikacije, Sabornog uloženija od 1649. godine, koje se odnose na načelo zakonitosti i komplementarne pravne principe. Na osnovu rezultata dobijenih analizom ruskih pravnih spomenika i konkretnih istorijskih prilika XVI i XVII veka, autor daje kratak završni uvid o načinu nastanka i političkoj ulozi načela zakonitosti, odnosno ideje o supermatiji prava u Moskovskoj Rusiji i u srednjovekovnoj Engleskoj, koja se smatra otadžbinom te ideje.sr
dc.description.abstractThis research concentrates on emergence and development of the principle of legality in the Russian law of 16th and 17th century. The paper begins with a review of the thesis that Russian state was an oriental despotism and denies even existence of an idea about supremacy of law in any period of the Russian legal system development. For the purpose of contesting this thesis, deeply ingrained in the Western European social science, this article elaborates Russian legal sources of 16th and 17th century. Firstly, Sudebnik from 1550 as the first Russian legal document which contains a regulation that declares statute as the only source of law and which also provides legal procedures in courts and administration. Emergence of the principle of legality in Russian law is usually brought into relation with social, organizational and territory changes that Moscow Russia was undergoing at the beginning of rule of the Emperor Ivan IV. In addition, this article is analyzing provisions of Ulozenije from 1649 that speak about further development of the principle of legality in Russian legal system of 17th century.en
