dc.description.abstractNormativno uređenje delatnosti javnog beležnika na području Republike Srbije datira još od 1930. godine kada je donet Zakon o javnim beležnicima Kraljevine Jugoslavije. Međutim, u sadašnjem pravnom sistemu Srbije, nakon nekoliko bezuspešnih pokušaja da se ponovo uvede ova ustanova, konačno je 2011. godine donet Zakon o javnom beležništvu Republike Srbije, dok je njegova primena odgođena sve do septembra 2014. godine. Tim zakonom je ponovo uspostavljena delatnost javnog beležnika koji preduzima određenu vrstu poslova iz svoje nadležnosti, između ostalog, i u oblasti porodičnog prava. Nakon ponovnog uspostavljanja nadležnosti javnog beležnika u pravnom sistemu Srbije usledile su i izmene i dopune porodičnog zakonodavstva, u koje je uvrštena ustanova javnog beležnika, a njegove nadležnosti su precizirane u porodičnom pravu. Značaj uvođenja i normiranja te delatnosti je nesporan, imajući u vidu da brojne novine koje se odnose na prenošenje nadležnosti sa sudova na javne beležnike doprinose ne samo rasterećenju sudova već i efikasnijem postupanju, jer su pojedine radnje i postupci pojednostavljeni. Cilj ovog rada je da se analizom normi o nadležnosti javnog beležnika u porodičnom pravu doprinese razumevanju njihove uloge i naučnoj raspravi o celishodnosti zakonskih rešenja u toj oblasti prava. U radu će biti analizirane i odredbe o nadležnostima javnog beležnika u porodičnom zakonodavstvu Hrvatske, Crne Gore i Bosne i Hercegovine, sa ciljem da se u uporednopravnoj analizi uoče eventualne normativne razlike uz komentar pozitivnopravnih rešenja.sr
dc.description.abstractThe institution of the notary public is not a novelty in the Republic of Serbia, having in mind that the normative regulation of this activity dates back to 1930 when the Public Notaries Act of the Kingdom of Yugoslavia was enacted. However, there were several attempts and efforts to reintroduce this institution in the current Serbian legal system, but without success, until recently. Although the Public Notaries Act of the Republic of Serbia was adopted in 2011, its implementation has been delayed until September 2014 and has so far undergone several amendments. After re-establishing the jurisdiction of the notary public in the Serbian legal system, amendments to domestic family law legislation, in which the institution of notary public is incorporated, were followed by specifying its jurisdiction in family law. Therefore, the importance of the introduction and legal regulation of the institution of notary public is undeniable, given the number of novelties in terms of transferring jurisdiction from courts to notaries public, which should lead to greater procedural efficiency and which would certain procedures and formalities made easier. In this paper, the provisions on jurisdiction of the notary public in family law of Croatia, Montenegro and Bosnia and Herzegovina will also be analysed.en
