dc.description.abstractDolaskom nacionalsocijalista na vlast promenile su se društveno-političke okolnosti u Nemačkoj koje su nužno uticale na pravo i pravni poredak. Nova vlast je želela da izgradi novi pravni poredak u skladu sa ideologijom nacionalsocijalizma. Pošto zakone, koji su doneti pre 1933. godine, nije bilo moguće promeniti u kratkom vremenskom roku, nacistička pravna teorija je pristupila teorijskom redefinisanju pojma prava i nametnula stanovište da se svi zakoni moraju tumačiti u duhu nacionalsocijalizma, odnosno da im se mora dati novo nacionalsocijalističko značenje. U ovom radu autori analiziraju teorijsko-ideološke osnove takvog tumačenja, koje je posleratna nemačka literatura nazvala neograničenim tumačenjem prava, ističući njegovu ulogu u nacionalsocijalizaciji nemačkog građanskog prava, uz prikaz relevantne sudske prakse. Na kraju, autori čine kratak osvrt na proces posleratne denacifikacije nemačkog prava koja se, takođe, sprovodila tumačenjem, ali ovoga puta sa ciljem da se iz pravnih normi koje su donete za vreme Hitlerove diktature eliminiše nacionalsocijalistička ideologija.sr
dc.description.abstractWhen the Nazis came to power in 1933, they began to rebuild the German legal system in accordance with the National Socialism ideology. Considering it was impossible to complete this task overnight, the Nazi legal theory established the view that all acts and statutes enacted prior to 1933 must be interpreted in the interest of National Socialism. In this paper the authors analyse the theoretical foundations of such interpretation, which was marked as unrestricted interpretation of law in post-war legal theory, focusing on its role in the process of Nazification of German civil law that was actively practiced by German courts. The authors also briefly analyse the post-war process of denazification of the laws enacted during the Nazi era, which was also performed by the mean of legal interpretation, but this time with the aim of eliminating the Nazi ideology from legal rules.en
