Izbor i sastav ustavnih sudova : Mukotrpan put dostizanja evropskih standard

Abstract

Питање састава и начина избора судија уставних судова има по- себан значај за обезбеђење организационог аспекта независности ове институције. Успостављен као заштитник и чувар устава и уставом ујемчених људских права, уставни суд мора бити сачињен од судија које одликује лични и професионални углед у друштву стечен радом у најеми- нентнијим институцијама, највише правничко образовање, препо– зна- тљива професионална постигнућа, осведочена лична и професио– нална моралност, који се бирају или именују на начин који онемогућава поли- тичке утицаје. У европским уставносудским институцијама судије нај- чешће потичу из редова највиших универзи тетских звања и највиших судских инстанци, доказујући на тај начин да уставни судови налажу највиши степен стручне остварености, како би деловањем у оства- ривању уставом успостављене надлежности ових органа били у могућ- ности да на прави начин остваре њихову уставну мисију.

The question of composition and modality of constitutional court judges appointment is of special importance for safeguarding the organizational aspect of this institution’s independence. Being established as the protector and guardian of the constitution and the constitutionally guaranteed human rights, constitutional court must consist of judges distinguished by personal and professional social prestige acquired from their careers in the most eminent institutions, the highest legal education, acknowledged professional achievements, proven personal and professional morality, which are being chosen or nominated in the way that disables political influences. In the European constitutional courts judges often come from the ranks of highest university academics and highest judicial instances, proving in this way that constitutional courts require the highest degree of vocational accomplishment, so as to properly fulfill their constitutional mission by operating in the effectualization of the constitutionally established jurisdiction of these organs.
