dc.description.abstract | Praksom Suda pravde Evropske unije poslednjih nekoliko decenija razvila su se određena načela takozvanog evropskog upravnog prava koja su obavezujuća za sve aktere koji vrše upravnu funkciju na nivou Evropske unije, bilo da su u pitanju institucije, ili druga tela, agencije i kancelarije Evropske unije, ili nacionalni organi koji podeljeno ili samostalno vrše upravne funkcije Evropske unije. Buduća obaveza nacionalnih uprava da poštuju načelo evropskog upravnog prava, uslovila je analizu stava organa koji vrše kontrolu uprave o obaveznosti dosledne primene načela upravnog procesnog prava i poštovanja ljudskih prava bez obzira na nedostatke određenih zakona koji sadrže rešenja koja su u suprotnosti sa ovim načelima i ljudskim pravima. | sr |
dc.description.abstract | The practice of the Court of Justice of the European Union in recent decades has developed certain principles of the so-called European administrative law that are binding on all actors who exercise administrative functions at the level of the European Union, wether within institutions, other bodies, offices and agencies of the European Union or national organs that together with others or independently perform administrative functions of the European Union. Future obligation to respect the principles of European administrative law by national administrations has conditioned the analysis of the position of organs exercising control of the administrations’ obligation of consistent application of the principles of administrative procedural law and respect for human rights, regardless of the shortcomings of certain laws that contain solutions that are inconsistent with the principles and human rights. | sr |
