dc.description.abstract | Voda je jedan od najvažnijih prirodnih resursa na svetu i resurs neophodan za život čoveka. Kako pristup čistoj vodi danas predstavlja veliki problem za mnoge delove sveta, nije iznenađujuće to što je javnost burno reagovala kada je u februaru ove godine Evropski parlament, na predlog i po nacrtu Evropske komisije, doneo direktivu kojom pravo na vodu faktički više nije ljudsko pravo, već se pijaća voda, neophodna za život ljudi, tretira, u pravnom smislu, poput građevinskog zemljišta, tj. kao koncesija. Pravnici širom Evrope smatraju da je time Evropa odstupila od tekovina rimskog prava, po kojem je voda res extra commercium, a Evropska građanska inicijativa „Pravo na vodu” inicirala je peticiju protiv privatizacije vodovoda, u kojoj se iznosi protivljenje deregulaciji vodoprivrede (kako je predloženo u direktivi o uslugama u Evropskoj uniji) i zahteva da Evropska komisija pravo na čistu pitku vodu uvrsti u osnovna ljudska prava. S druge strane, pravnici koji podržavaju ovo rešenje kao argument za takvu odluku Komisije i Evropskog pralamenta navode da je konkurencija preduslov za fer poslovanje i da od nje koristi imaju pre svega potrošači jer će usluge postati bolje i jeftinije. | sr |
dc.description.abstract | Water is one of the most important natural resources and necessary for human life. Access to clean water is a major problem for many parts of the world. The so-called Concessions Directive, the question of water liberalisation has been put on the table by the Commission only to forced back by public opposition. The concessions directive, which has the stated object of opening markets and eliminating „discrepancies among national regimes”, would end the exemption that has so far existed for drinking water supply and for the first time bring it under the rules of the EU’s single market. The directive would not directly force municipalities to privatise, but could lead to ‘privatisation through the back door’. ECI Right2Water invite the European Commission to propose legislation implementing the human right to water and sanitation as recognised by the United Nations, and promoting the provision of water and sanitation as essential public services for all. The EU legislation should require governments to ensure and to provide all citizens with sufficient and clean drinking water and sanitation. | sr |
