Nov Zakon o upravnom postupku u kontekstu pristupanja Srbije Evropskoj uniji

Abstract

U Izveštajima Evropske komisije o napretku Srbije, između ostalog stoji da „tek treba usvojiti nov zakon o upravnom postupku“. Ministarstvo za državnu upravu i lokalnu samoupravu u skladu sa Akcionim planom za sprovođenje reforme javne uprave Srbije za period 2014-2016. godine privodi kraju nov Zakon o opštem upravnom postupku (ZUP) koji treba da se usvoji do kraja 2015. godine. U odnosu na postojeći ZUP, novi ZUP-a sadrži veći broj inovacija, mada prema poslednjoj radnoj verziji postoji potreba za vertikalnim i horizontalnim usklađivanjem koletaralnog zakonodavstva, uvođenje elektronske tehnologije, a iznad svega blagovremena i obuhvatna edukativna priprema upravnih službenika kroz programe inovacija znanja i proširivanja profesionalnih kapaciteta.

The Serbia Progress Reports of the European Commission state that the „Law on General Administrative Procedure is still to be adopted“. The Ministry of Public Administration and Local Self-Government, which is charged by the Action Plan for the Implementation of the Strategy for the Reform of the Public Administration of Serbia for the 2014-2016 period is finalizing the new Law on General Administrative Procedure (GAPA) which is to be adopted by the end of 2015. In comparison with the existing Law, the new GAPA contains numerous innovations, but according to the most recent draft version, there is need for vertical and horizontal harmonization with other legislations and by-laws, introduction of IT, and comprehensive education of the managers of the administrative procedures in order to enhance their professional capacities to implement the new Law.
