dc.description.abstractZaštitnik građana, kao nezavisna državna institucija u pravnom sistemu Srbije, suočava se sa jednim brojem otvorenih pitanja u ostvarivanje svoje osnovne ustavne funkcije zaštite i unapređenja ljudskih prava. U pravni sistem Srbije, instituciju Zaštitnika građana uvodi Ustav iz 2006. godine. Zaštitnika građana bira i razrešava Narodna skupština. Zakon o Zaštitniku građana usvojen je 2005. godine. Analiza funkcija i nadležnosti Zaštitinika građana u aktuelnom kontekstu zaštite ljudskih prava u Srbiji pokazuju određeni broj protivrečnosti između normativnog okvira koji reguliše nezavisan ustavni status ove institucije i prakse efikasnog ostvarivanja poverenih ustavnih i zakonskih nadležnosti. Pojedini negativni indikatori ukazuju na tendencije uticaja ombudsmana na rad sudova, dok drugi ukazuju na pasivnost i pad poverenja građana u instituciju Zaštitnika građana.sr
dc.description.abstractThe Citizen’s Protector (ombudsman), as an independent authority in the legal system of Serbia is faced with open issues in delivering its basic constitutional function of protecting and upgrading human rights. In the legal system of Serbia, the Citizen’s Protector was introduced by the Constitution of 2006. The La on the Citizen’s Protector was adopted in 2005. The National Assembly appoints and dismisses the Citizen’s Protector. Analysis of the functions and competences of the Citizen’s Protector in the present context of protecting human rights in Serbia shows a number of contradictions between the legislative framework which regulates the independent constitutional status of this institution and the efficient realization of the mandated competences. Certain negative indicators point to the tendency of the ombudsman to extend control over courts, while other indicators point to the passive activity of the ombudsman and decline of trust of citizens in the institution of Citizen’s Protector.sr
