dc.description.abstract | Evropska konvencija o ljudskim pravima jemči osnovno pravo muškarcima i ženama da sklapaju brak i zasnivaju porodicu. Nacionalni zakoni država članica uređuju ostvarivanje tog prava, ali ograničenja koja uvode ne smeju da ograniče ili umanje to pravo na takav način ili u toj meri da bude oštećena sama suština prava na brak. Evropski sud za ljudska prava i Evropska komisija za ljudska prava nekoliko puta su se izjašnjavali o zabranama koje ometaju punovažno sklapanje braka i postavili su odgovarajuće standarde o tome. Posmatrajući te standarde, možemo sa sigurnošću reći da su u srpskom pravu svi oni već implementirani, osim onog koji se odnosi na obavezu država članica da pravno priznaju i životne zajednice osoba istog pola. | sr |
dc.description.abstract | The European Convention on Human Rights (Article 12) secures the fundamental right of men and women to marry and to found a family. It is subject to the national laws of the Member States but the limitations thereby introduced must not restrict or reduce the right in such a way or to such an extent that the very essence of the right is impaired. The European Court of Human Rights and the European Commission on Human Rights have repeatedly argued on bans that hinder the conclusion of a valid marriage and set appropriate standards for it. Looking at these standards, we can say with certainty that they have already been implemented in Serbian law, except for the obligation of the Member States to legally recognize same-sex unions. | sr |
