Pravni režim sanitarnih i fitosanitarnih mera u međunarodnoj trgovini

Abstract

У овом раду аутори приказују правни режим санитарних и фитосанитарних мера у међународној трговини, и то пре свега из перспективе права Светске трговинске организације, будући да су регионални и национални прописи у овој области изведени из Спо- разума о санитарним и фитосанитарним мерама, или се на њега експлицитно позивају. Нарочита пажња је посвећена општим прин- ципима правног уређења санитарних и фитосанитарних мера, као и основним обавезама у погледу ове врсте мера: процени и управљању ризицима, изједначавању прописа, прилагођавању регионалним ус- ловима, усклађености поступака контроле, инспекције и издавања дозвола, транспарентности и техничкој помоћи. За крај, уместо закључка, аутори преносе тзв. „десет заповести“ за исправну при- мену прописа о санитарним и фитосанитарним мерама, а које могу да буду од изузетног практичног значаја и за Републику Србију, у контексту њених напора ка придруживању Светској трговинској организацији и Европској унији и хармонизацији њених пропи- са о спољнотрговинском пословању са правним тековинама ових организација.

The paper focuses on the legal treatment of sanitary and phytosanitary measures in international trade, from the perspective of the rules adopted within the World Trade Organization. The WTO law is taken as a point of reference since regional and national rules on sanitary and phytosanitary measures derive from or explicitly point to the WTO rules. A special attention is given to the basic principles that govern the legal treatment of the aforementioned measures, as well as to the basic obligations related to them: risk assessment and risk management, equivalence, adaptation to regional conditions, control, inspection and approval procedures, transparency and technical assistance. In the end, instead of a conclusion, the authors present to so-called “Ten Commandments of the SPS Agreement”, a set of instructions for proper application of the SPS Agreement which may prove to be useful to the Republic of Serbia as well, especially in light of its efforts to join the World Trade Organization and the European Union and harmonize its law with the acquis of those organizations.
