Kriza Svetske trgovinske organizacije i pristupanje Srbije

Abstract

Заједничка трговинска политика Европске уније усклађена је са прописима и правилима Светске трговинске организације, чији је Унија члан. Из тог разлога се од свих кандидата за чланство у ЕУ очекује да претходно приступе СТО. Република Србија већ ско- ро петнаест година води приступне преговоре са СТО. Највећи део прописа везаних за спољнотрговинско пословање је већ усклађен са захтевима Организације, али и даље преостаје неколико изоло- ваних али значајних питања у којима потребна хармонизација још увек није остварена. Истовремено, СТО пролази кроз период кри- зе коју је узроковало неколико фактора. Прво, сама Организација је, током година свог постојања, показала одређене слабе тачке које је потребно санирати. Друго, Доха рунда преговора која је тренут- но у току прекомерно се одужила, не доноси очекиване резултате и указује на структурне проблеме у Организацији. Коначно, Апелацио- но тело, једна од специфичности система решавања спорова СТО, ће можда бити онемогућено да поступа од децембра 2019. године јер Сједињене Америчке Државе блокирају избор његових нових чла- нова. Уколико до прекида рада Апелационог тела заиста дође, читав систем решавања спорова ће морати да буде редефинисан. У светлу изложеног, овај рад разматра приступну позицију Србије у контек- сту изложених проблема који тренутно потресају СТО и указује на могуће путеве даљег поступања.

The Common Commercial Policy of the European Union is harmonized with the rules and disciplines of the World Trade Organization. This comes as no surprise, seeing that the EU is a member of the WTO. Consequently, EU requires all the candidates for accession to become members of the WTO prior to joining the EU. The Republic of Serbia has been negotiating its terms of accession to the WTO for almost 15 years. The largest part of the foreign trade legislation is already harmonized with the WTO rules and disciplines, but there remain some isolated but important issues where the necessary compatibility is still not reached and where further action is required. At the same time, the WTO itself is going through a crisis caused by several factors. First, over the years of its functioning, the WTO has displayed some structural shortcomings that need to be rectified. Second, the ongoing Doha round of negotiations lasts much longer than initially scheduled but does not bring the desired results. Additionally, the crisis of negotiations has pointed to some inherent deficiencies of the current WTO system. Finally, the Appellate Body, one of the very specific features of the WTO dispute settlement system, may become paralyzed as of December 2019 since the United States of America are blocking the election of its new members. If the Appellate Body really ceases to function, this will inevitably lead to fundamental changes in the WTO dispute settlement system. In light of the above, this paper focuses on the position of Serbia in the context of the above-mentioned problems in the WTO and explores the possible ways of moving the accession process forward.
