Aktuelni pristupi regulatornom okviru virtuelnih valuta – u susret Zakonu o virtuelnoj imovini

Abstract

Успон тржишта криптовалута отворио је низ питања која се односе на њихове предности и ризике. Као нови облик виртуелне имовине, криптовалуте карактерише специфична технолошка ин- фраструктура. Да би се сагледала регулаторна перспектива крип- товалутног тржишта, неопходно је укратко указати и на њихов развој, елементе инфраструктуре индустрије виртуелних валута и појавне облике односно класификацију виртуелних валута. Потом је важно сагледати њихове импликације на финансијско посредовање и финансијску инфраструктуру, као и финансијску стабилност. У раду се идентификују основна питања регулаторног оквира тржишта виртуелних валута и основни приступи обухвату регулације. Упоред- на регулаторна пракса одабраних земаља, као и глобална регулатор- на перспектива овог тржишта, служе као водич за оцену постојећег регулаторног оквира и регулаторних изазова који се постављају у Србији у погледу развоја виртуелних валута и њихове технологије.

The rise of the cryptocurrency market has opened up a number of questions on their benefits and risks. As a new form of virtual assets, cryptocurrencies are characterized by a specific technological infrastructure. In order to understand the regulatory perspective of the cryptocurrency market, it is necessary to briefly present their development, elements of the infrastructure of the virtual currency industry and the forms or classification of virtual currencies. Subsequently, it would be important to consider their implications of the use of virtual currencies on financial intermediation and financial infrastructure, as well as financial stability. The paper identifies the basic issues of the virtual currency market’s regulatory framework and the extent of applicable regulatory approaches. Comparative regulatory practices of selected countries, as well as the global regulatory perspective of this market, serve as a guide to assess the existing regulatory framework and regulatory challenges posed in Serbia in terms of the development of virtual currencies and their technology.
