Protection of workers with family duties

Abstract

The topic of this thesis is the protection of workers with family duties. The thesis aims to contribute to the debate in Serbia and Europe about the protection of labor rights of this category of workers. It consists of the analysis of respective legal framework of the UN, ILO, CoE and the EU, in particular of the Workers with Family Responsibilities Convention No. 156 and of the Council Directive 2010/18/EU of 8 March 2010 implementing the revised Framework Agreement on parental leave, and of an overview of legal framework for the protection of workers with family duties in selected European countries: Sweden, Czechia, United Kingdom and Serbia. It concludes that in the rapidly changing modern context the topic of the thesis is becoming ever more important for all involved: workers, employers and states on equal footing. In the case of Serbia, given the challenging position of workers with family duties and gaps identified in legislation, it advocates for its further alignment with ratified international instruments and effective implementation.

Tema ove teze je zaštita radnika i radnica sa porodičnim dužnostima. Njen cilj je da pruži doprinos debati u Srbiji i Evropi o zaštiti radnih prava ove kategorije radnika i radnica. Teza se sastoji od analize relevantnog pravnog okvira UN, MOR, SE i EU, na prvom mestu Konvencije br. 156 o radnicima sa porodičnim obavezama i Direktive Saveta 2010/18/EU od 8. marta 2010. godine o sprovođenju revidiranog Okvirnog sporazuma o roditeljskom odsustvu, i od pregleda pravnog okvira za zaštitu radnika i radnica sa porodičnim dužnostima u odabranim evropskim zemljama: Švedskoj, Češkoj, Ujedinjenom Kraljevstvu i Srbiji. U tezi se zaključuje da njena tema, u savremenom kontekstu koji se brzo menja, postaje u jednakoj meri sve značajnija za sve uključene strane: radnike i radnice, poslodavce i države. Kada je reč o Srbiji, imajući u vidu izazovan položaj u kojem se nalaze radnici i radnice sa porodičnim dužnostima i uočene praznine u zakonodavstvu, teza zagovara njegovo dalje usklađivanje sa potvrđenim međunarodnim instrumentima i delotvornu primenu.
