dc.description.abstractPosrednici, kako Internet provajderi tako i pružaoci hosting usluga, imaju ključnu ulogu u saopštavanju autorskih dela na Internetu. U većini uporednopravnih sistema posrednici neće odgovarati za povredu autorskog i srodnih prava na Internetu pod uslovom da u njoj nisu aktivno učestvovali. Ipak, poslednjih godina primećuje se značajna promena u režimu odgovornosti posrednika: prava Francuske i Republike Koreje, na primer, nameću posrednicima obaveze činjenja, dok se prema korisnicima Interneta koji povrede autorsko ili srodna prava primenjuje tzv. pravilo trostrukog udara. Autor analizira promene u režimu odgovornosti posrednika kako na nivou nacionalnih autorskopravnih propisa i sudske prakse, tako i na međunarodnom nivou gde se trenutno pregovara o zaključenju sporazuma o borbi protiv piraterije.sr
dc.description.abstractIntermediaries, both connectivity providers and content hosts, have a crucial role in copyright content transmission on the Internet. According to rules in force in most jurisdictions, intermediaries can take advantage of 'safe harbor' provisions by remaining passive hosts or service providers. However, a different trend seems to be emerging, modifying the role of intermediaries from passivereactive to active enforcers of copyright and related rights. Laws of France and the Republic of Korea for example impose on intermediaries a pro-active role, coupled with a 'three-strikes' rule applied to Internet users who infringe copyright or related rights. The author detects this trend in recent legislative enactments and national case law, as well as on the international level where a new anti-counterfeiting agreement is being negotiated.en
