dc.description.abstractAutor u ovom radu izveštava javnost o aktuelnom 'normotkalačkom' naporu u Republici Srbiji u oblasti onih društvenih odnosa koje obično nazivamo lobiranje. Pristup lobističkoj aktivnosti koji autor 'krsti' kao 'čisto pravni' (bez političkih i drugih sličnih uticaja) je ovde predstavljen u formi 'Skice za Zakon o lobiranju'. Ova naučna inicijativa uzima u obzir normativna rešenja drugih zemalja, pre svih: SAD, Kanade i Nemačke, ali i nadnacionalna pravila promovisana na nivou Evropske unije. Kako, ni u ovom slučaju, 'slepo prepisivanje' ne može uroditi dugoročnim i pouzdanim rezultatom, Skica predstavlja pokušaj da se prosejavanjem uporedno-pravne prakse ponajbolja ('zlatna') pravila izdvoje i uz neophodna prilagođavanja ugrade u srpsko pravo. Autor predlaže da se aktivnost ovlašćenih lobista de lege ferenda uredi na principima javnosti i zabrane nedozvoljenog uticaja. Samo na ovaj način, lobiranje u Srbiji može zaživeti kao konstruktivno informisanje donosioca odluke, u službi očuvanja demokratije i opšteg blagostanja.sr
dc.description.abstractThe author in this article informs the professional audience about actual efforts at suggesting norms activity related to lobbying. The accepted view that author describes as 'pure legal' approach (i.e. without political or any other interference) is presented here in the form of the 'Lobbying Act Draft'. This scientific initiative takes into account the legislative solutions adopted in other countries, particularly in: USA, Canada and Germany, as well as the rules promulgated at the supranational/EU level. Naturally, like in any other case of law reform by legal transplantation 'mere copying' could not bring trustworthy and long-lasting results. Therefore, this Draft represents an attempt to integrate the best comparative practice and Serbian public law tradition. Further, the author suggests that lobbying activity de legeferenda should be regulated based on the fundamental principles of transparency and prohibition of undue influence. Only in this way, lobbying in Serbia could begin to live as a constructive activity of informing the public office holder, carried out protecting democracy and common welfare.en
