dc.description.abstractUgovor o organizovanju putovanja, kao najznačajniji ugovor u turizmu, nije jednostavno definisati. Njegove osnovne karakteristike nisu univerzalno prepoznatljive, jer međunarodni i nacionalni izvori ne sadrže uniformna rešenja. Poređenjem definicija ovog ugovora sadržanih u Briselskoj konvenciji, Direktivi o paket aranžmanima i Predlogu nove direktive o paket aranžmanima, autor uočava progresivan razvoj međunarodne regulative, ali i prilagođavanje pojma ovog ugovora novim okolnostima. Ugovor o organizovanju putovanja je u srpskom pravu paralelno uređen Zakonom o obligacionim odnosima i Zakonom o zaštiti potrošača. Ova dva zakona sadrže u osnovi različite definicije ovog ugovora, što je od velikog praktičnog značaja, jer je time aktuelizovano pitanje da li se Zakon o obligacionim odnosima uopšte primenjuje na ovaj ugovor nakon stupanja na snagu Zakona o zaštiti potrošača. U ovom članku, autor analizira osnovne karakteristike ugovora o organizovanju putovanja, a nakon toga utvrđuje u kojoj meri srpski propisi integrišu takve teorijske koncepcije. Na kraju su date preporuke za redefinisanje pojma ovog ugovora u pozitivnopravnim propisima.sr
dc.description.abstractThe organized travel contract, as the most important contract in the area of tourism, is not easy to define. Major features of this contract are not universally recognizable, because international and national sources of law do not share uniform ideas. By comparing the definitions of organized travel contract in Brussels convention (CCV), Directive on package travel, package holidays and package tours and Proposal for new directive on package travel, the author determines the progressive development of international regulation, as well as the adaptation of this contract to new circumstances. In Serbian law the organized travel contract is regulated by the Law on obligations and Law on consumer protection. These two laws contain basically different definitions of this contract, which is of great practical significance, because by delineating the definitions we are answering the question whether the Law on obligations is applicable after entering into force of the Law on consumer protection. In this article, the author analyzes the basic characteristics of organized travel contract, and afterwards explores whether the Serbian regulation implements these ideas. At the end, the author concludes that the Serbian current regulation of this topic has to be improved and suggests the ways of future development.en
