dc.description.abstractU radu se razmatraju uslovi za oslobođenje dužnika od odgovornosti za štetu, koju je prouzrokovao neizvršenjem ugovora ili zadocnjenjem u njegovom izvršenju. Osnovno pitanje koje se postavlja povodom opšteg pravila Zakona o obligacionim odnosima o oslobođenju od ugovorne odgovornosti (čl. 263 ZOO) jeste da li se dužnik može osloboditi odgovornosti dokazujući da nije kriv za štetu nastalu zbog neizvršenja obaveze ili samo ako dokaže nastupanje okolnosti, koje predstavljaju višu silu. Iz odgovora na postavleno pitanje se izvodi zaključak da li je ugovorna odgovornost subjektivna ili objektivna. Kako bi analiza bila potpunija, autor navodi primere pojedinih trgovinskopravnih ugovora (ugovor o uskladištenju, ugostitelska ostava, ugovor o prevozu stvari, ugovor o prevozu lica), razmatrajući odredbe ZOO povodom oslobođenja od ugovorne odgovornosti kod tih ugovora. S obzirom na to da su pojedina rešenja promenjena u Prednacrtu Građanskog zakonika, autor analizira i njegove odredbe, kako bi se videlo do kojih će promena doći donošenjem Građanskog zakonika i daje ocenu novih rešenja.sr
dc.description.abstractIn this paper the author analyzes the conditions for the debtor's exemption from liability for damages, which is caused by his failure to perform any of his obligations under the contract or by his late performance. The main question that arises in regard to the general rule of the Serbian Law on Contracts and Torts (LCT) on exemption from contractual liability (Article 263) is whether the debtor may be exempted from liability by proving that there is no fault on his part or only by proving the circumstances which represent force majeure. The answer to this question leads to the conclusion whether contractual liability is subjective or objective. In order to have complete analysis, the author examines some commercial contracts (contract for the storage of goods, deposit with an innkeeper, contract for the carriage of goods, passenger transport contract), considering provisions of the LCT on the exemption from liability in these contracts. Given the fact that some solutions are changed in the Draft of the Serbian Civil Code, the author also analyzes its provisions in order to see to what extent would new provisions change current regulation, and gives the assessment of the new solutions.en
