dc.description.abstractU ovom prilogu za savetovanje izlažu se tri presude najviših srpskih sudova, kojim se očigledno povređuju pravila zakona u oblasti privrede. Za svaku presudu se iznose čvrsti razlozi njene protivzakonitosti, kao i što se razmatraju razlozi koji su doveli do toga. Pisac ukazuje na štetnost takvih presuda ne samo po oštećenu stranku u parnici, već i po ceo pravni poredak i privredu naše zemlje. Kad se sudska praksa po protivzakonitoj presudi ujednači, stvara se novo opšte pravno pravilo (sudsko pravilo), kojim se ukida se zakonsko pravilo u odnosu koji se njime uređuje. Time se prebacuje rizik imovinskog gubitka zbog nepoštovanja zakonskog pravila sa one strane u pravnom odnosu koja ga je povredila na onu koja ga je poštovala. To je pogubno za pouzdanje ljudi u sudski sistem i pravni poredak zemlje. Pisac ukazuje i na valjanost sudske prakse u tekućim parnicama korisnika kredita sa bankama. Na kraju priloga se razmatra objavljivanje sudske prakse u Srbiji i ukazuje da je taj posao beznačajan, ako se obavlja na sadašnji način.sr
dc.description.abstractThis contribution for the conference deals with the three judgements of the highest Serbian courts which obviously contravene statutory rules within the economy sector. The author points out clearly to the reasons of the illegality of each of these judgements, guessing if the cause of that is ignorance of judges, their sycophancy or something else. He highlights the noxiousness of such judgements not only for the aggrieved party in litigation, but also for the whole legal realm and economy of the country. When judicial practice unifies itself on the ground an illegal judgement, it creates a new general rule (judicial rule), by which it repeals statutory rule in certain legal relationship. It shifts the risk of property loss due to the disrespect of the statutory rule from the party, which respect that rule to the party which did not respect it. That is disastrous for the people's trust in the judicial system and legal realm of the country. The author also points out to the good judicial practice in the current litigations of credit users with banks. Lastly, he analyses publication of judicial practice in Serbia, alleging that that business is useless, if it is carried on in the present way.en
